This is the 2nd file where Dan Perry writes to the HOA BOD. In this correspondence D Perry clearly recognizes that the HOA has had FULL oversight, control and was responsible of ALL Bingo operations, legal or illegal.
D Perry further goes on to highlight that the HOA BOD did NOT want to draw attention to the fact that Paul Pontious may come under a formal investigation while he was running for a HOA BOD seat. I am not a lawyer but sounds like collusion to me and the fact that D Perry seems to support the decision by the HOA BOD to ‘hide” the truth behind this issue, since D Perry does not advise that such an act (hiding the fact of mishandling of Bingo operations and its monies as well as the potential of criminal acts) could be perceived as collusion.

Again I am not a lawyer or claiming that this was done by anyone, it just ‘appears’ that by intentionally hiding the fact that there were mishandling of Bingo monies on behalf of Paul Pontious and the HOA BOD, in order to get Paul Pontious elected, seems odd to me and I would think the community would be very surprised by the fact the HOA BOD is misleading them on this issue. If they (HOA BOD) are willing to mislead us on such a major issue, what else are they will they mislead the community on? I guess that is why the HOA BOD is working so hard to suppress any further discussion on this issue.
Attached is D Perry’s suggested draft of the HOA BOD dissolve their relationship with Bingo, of which was never submitted. Why? Because the HOA BOD decided to follow D Perry’s legal advice to ‘allow’ this issue to “temporarily die” within “…the Community than open yourself (Dave Ross and BOD) to being the subject of an expanded criminal investigation by law enforcement…”
Seems that the lawyer, Dan Perry, clearly recognized that a very thorny legal issue was on the horizon with the result of several being held accountable and advised the HOA BOD to conceal this issue in effort to allow the community to forget or be subject to a misinformation campaign that intentionally misinformed the community as to what really was going on.
If this is in fact true, then as Ricky Recardo would say “… someone has some splain to do..”
