Many board members and managers of community associations are really working hard to make a laughing stock out of themselves. The latest story of the "folks in charge" making little or no sense happened in SUMMERFIELD/RIVERWALK VILLAGE ASSOCIATION, INC. in Bradenton.
And the media is having a field day:

It seems the words "SELECTIVE ENFORCEMENT" are virtually unknown in this community and especially among the members of its "leadership."
Alan Roth, a District 1 supervisor whose wife is on the Summerfield/Riverwalk Homeowners Association's deed compliance committee, was totally upset when called upon the fact that his lawn was violating the same rules as the owner who got fined $1,600 for his lawn violation. That really didn't sit well with Roth -- and he more or less blamed the owner who took the pictures showing his violations. Instead of acknowledging his own violations, Roth blamed the person who got fined and came up with the disingenuous statement: “If you don’t like the rules of any club, join another club.”
My suggestion sounds a little different: "If your club is run by morons, kick out the morons!"
Why is it that many board members always think that the rules only apply to the lowly homeowners, but not to the so-called leadership?
Incidents like this are pretty common in community associations since Florida failed to create any regulation for the estimated 2.5 million homes within mandatory homeowners' associations (See OPPAGA REPORT).
The icing on the cake in this case was supplied by Cynthia Wills, CMCA, AMS, Director of Community Associations. When the owner, who was fined $1,600, showed up in front of the kangaroo court with the fancy name of "DEED COMPLIANCE COMMITTEE" with witnesses to defend her case, two of these witnesses were kicked out because "they were not homeowners." Coming back to following rules, the rules don't say that witnesses have to be deeded homeowners. Meaning these folks are not only violating their own rules, they are as well making up rules when it fits their purpose.
The owner, rightfully upset that her witnesses were kicked out dared to ask Manager Wills for the rules that allowed her witnesses to be kicked out. Since there were no such rules in place, Wills came up with a response that would have most likely made a second grader proud:

By the very fact that a homeowners association is not a public entity, but rather a private entity, makes meetings of that association private. It is not in the documents.

That surely leaves us all with one important unanswered question: "Shouldn't the members of the Board and the Compliance Committee be the first ones to be in compliance with the rules?"
This surely isn't the first time that I have heard complaints about Cynthia Wills, who has been described as “arrogant” by more than one owner. Actually, one owner described her as "the Queen Bee using the association as her kingdom, treating homeowners like her serfs!"
Wills' management style has created a rash of resignations in "Town Hall". Employees "resigning" from Town Hall called her style "abusive, cruel and harassing." The "OPEN LETTER" speaks for itself. It was sent to IDA on December 10, 2009 by one of the employees who resigned.
"Making up rules" seems to be only too common with this association's board and management. They already ran afoul with the Commission on Human Relations ("FCHR"). Cynthia Wills was the named defendant in a LAW-SUIT filed by the Florida Attorney General. The lawsuit alleged that defendants engaged in discriminatory housing practices in violation of § 760.37, Florida Statutes (2006), based on interference, coercion, or intimidation. The defendants settled the lawsuit out of court.
This case started out with a notice of violation of the "Business on Premises" rule. The notice stated the rule "does not permit a regular employee working out of the home." Actually, they only created the rule -- retroactively -- when they found out that such a rule didn't exist and they really had no rule disallowing a regular employee.
Imagine you moved -- by mistake -- into one of these communities where the leadership thinks that they can act as dictators. Isn't that a horrible thought?
Add the fact that Representatives Ambler (H 115) and Sachs and Senator Fasano (H1317/S1196) are pushing bills that would allow again the enforcement of fines, levied by these kangaroo courts, using liens and foreclosure.
That surely opens up the question:
Where do we have the bigger morons: In our community associations or in Tallahassee?
Is the Florida air causing these mental breakdowns –
or are we just living in a big loony bin?

Stamp Malfunction
The Postal Services created a stamp with a picture of President Obama on it. The Postal Service noticed that the stamp was not sticking to envelopes. This enraged the President, who demanded a full investigation. After a month of testing and $1.73 million in congressional spending, a special Presidential commission presented the following findings:

I Miss Bill Clinton

Sailwind Condo Assn. loses money to embezzler

A Gulf Breeze condominium association is refocusing its oversight practices after an estimated $114,000 was embezzled from its coffers by a former business manager.
Tina Dianne Mitchell, 40, of Pensacola, faces between 19 and 210 years in state prison when she is sentenced in Escambia County Circuit Court on Monday, March 15. Mitchell pleaded guilty Feb. 16 to embezzling more than $856,000 from five area homeowners associations – including Sailwind Condominium Association of Gulf Breeze – between 2006 and 2009 while she worked for two Pensacola area homeowner association management companies.
The woman pleaded guilty to three counts of money laundering and five counts of grand theft. According to the State Attorney’s Office, Mitchell engaged in a continuing scheme whereby she stole money from Sabine Yacht and Racquet Club, Heron’s Forest Property Owners Association, Inc., Bayview Terrace and Bay Wind Homeowner Associations.
Montgomery Management Associates, which employed Mitchell, first notified Sailwind of improprieties it discovered in March 2009. It rescinded its management representation and was replaced by Barrons Realty of Gulf Breeze.
“We didn’t pay attention,” Sailwind Condominiums Association Board Vice President Joe Concannon admitted. “We did not review the monthly bank statements, and she kept assuring us everything was fine.
“She was pretty good at covering everything up. She would make up fake income tax submissions, statements from banks, all kinds of fake stuff to make the books balance. The money was either going into her pocket or floating around between several associations. She had complete control through her company on all transactions or any activity.”
According to state prosecutor Troy Bouk, Mitchell wrote numerous checks of between $2,800 and $4,800 mostly to a joint account on her husband’s professional maintenance business account, which she also managed. She then would make withdrawals or expenditures including massive amounts of Mary Kay cosmetics, which she sold.
She drove a pink Cadillac that signified her elite status as a Mary Kay representative.
“In order to cover up her scheme,” Bouk said, “she drained some of the homeowners association accounts so badly that the HOAs were bouncing checks when they should have had several thousand dollars in their accounts. This was just after hurricanes Ivan and Dennis, and the HOAs were receiving large insurance payments. The insurance money would be deposited into their accounts, and that was sort of like a feeding frenzy for her.”
Concannon said Sailwind’s losses weren’t as severe as some of the other HOAs.
The association received a $50,000 reimbursement from its insurance company that wasn’t the result of a claim. That money apparently was skimmed, and Sailwind had to arrange incremental insurance payments for 2009 instead of a lump-sum advance payment.
“The hardship money we had put aside in reserves for roofs, shingles, siding, driveways and numerous repair needs . . . that money’s pretty much gone,” Concannon said.
“We haven’t had to have any special assessments. We haven’t raised the condo fee, and we haven’t eliminated anything. It’s just that the nest-egg that we had built is gone.”
Concannon said Mitchell also stole large, undetermined amounts of money from Sailwind’s coin-operated laundry service.
“There are no records of where that money went,” he said.
Treasurer Sue Miller is now closely monitoring Sailwind’s bank account on a regular basis.
Bouk said Montgomery Associates was a victim of sorts, too.
“They are now on the hook for all the wrongs she’s done because she was working for them,” the prosecutor said. “During the execution of her job duties, she defrauded a lot of people. I think there are civil lawsuits going in all directions.
“Montgomery Associates, as far as we know, never had any money stolen from them. But in terms of preponderance, they were victims.”
A call to Montgomery Associates owner Robert Montgomery seeking comment was not returned.

Villagers to lose their indoor pool

THE VILLAGES -- Lillian Campagnola, 73, exercises in the indoor heated pool at The Villages Wellness Center several times a week.
Because she's easily dehydrated, she can't participate in many outdoor activities. The pool is one of the only places the Villager can continue her exercise routine without getting dehydrated.
Plans to close the pool in June when the Wellness Center moves to the La Reina building in Spanish Springs will leave many residents with medical conditions without a place to exercise, she said.
"All we want is the pool to be maintained," she said, "even if that means charging memberships."
A letter sent to members from the Wellness Center last month stated the center was moving from its location near The Villages Regional Hospital on U.S. Highway 441 to expand its services. The new center will feature more exercise machines, classes and massage therapy services.
"With our growth in membership and utilization, a larger facility is much needed and this new location provides our members with numerous advantages," Terry Upton, general manager of the center, wrote in the letter. "While our new facility does offer many advantages, it does not provide for a swimming pool or hot tub. Knowing that some of our members enjoy those services only, we will refund the remaining balance on any membership if so requested."
Upton did not return calls for comment.
The center's pool is the only indoor heated pool in the huge retirement community. Those with skin irritations, joint problems and conditions like fibromyalgia (a muscle and connective tissue disorder) will have to go somewhere else to continue their routine, said Campagnola.
There are pools in other surrounding communities, but some residents can't drive to Leesburg or Belleview in Marion County because of their medical problems, she said.
Campagnola has gathered more than 150 signatures to ask the developers of The Villages to consider keeping the pool.
What the developers intend to do with the Wellness Center and the pool is a mystery to residents.
Villages spokesman Gary Lester could not be reached for comment.
Both homeowners associations in The Villages are picking up the pool issue.
Joe Gorman, president of the Property Owners Association, said they intend to pursue the issue. A lot of people moved to The Villages especially because they had access to an indoor pool, he said.
"We're concerned," Gorman said. "It does affect more than just a handful of people."
The Villages Homeowners Association is actively working with the Wellness Center and other entities to explore what the cost would be to build an aquatic center with a heated pool, said Roger Kass, president of the association, in a voicemail.
Ruthie Kelly, 78, who's had two strokes, said she and other residents plan broach the issue with the Amenities Authority when they meet on Feb. 11 at 1:30 p.m. to ask them to consider enclosing certain heated pools within The Villages.
Villagers pay monthly amenities fees to pay for facilities and services such as heated pools, community centers and activities throughout the community.
A member of the Wellness Center since 1999, Kelly uses the pool several times a week to exercise. Kelly said there must be an alternative for residents like herself.
"You're not going to displace these people," said Kelly. "It's a matter of health."

CDD COMMITTEE
Community Development Districts are getting more and more popular among politicians, developers and the whole connected industry. Local politicians love them, figuring they get all the future property taxes without having to invest anything. Developers can create their own little kingdoms without being supervised. They can write their own ticket and make huge profits without any big risks to them. The public bonds will finance all the necessary investments and if financial losses can't be avoided the homes of the people are the collateral for possible losses. Miscalculation from developers can be covered with money from the homeowners.
As in most cases the idea behind creating Community Development Districts is really good. But lack of supervision from the government agencies, which initially created these communities within communities, and the lack of enforcement of the existing Statutes, has definitely made many people think twice about the advantages of these developments.
Read the contents of these WebPages and support the demand for better legislation and especially enforcement of already existing Statutes. Homeowners just don't have the finances to battle rich developers in civil courts. Since the government sees fit to create these districts, they should please enforce the laws coming with it.

Paul Pontious is a lair.
How on earth could Paul Pontious get elected to the HOA when in fact he was breaking the Florida law on lotteries by having a 50/50 at Bingo. Not only that, he was spending the money on repairs on Lake Ashton and the Florida law says money must go to charities. He admitted he was spending the money for Lake Ashton by the article he wrote in the LA Times. Again he broke the law. When he was president of the HOA he sign a new covenants that says no smoking outside the main Ballroom door. On any Bingo night you can't see five feet ahead of you when you walk out the front door. I complain to Joe Hunter and of course he won't do nothing about the no smoking covenants because he is a good friend of Paul and he told me to get hold of George Flint. I E-mail George twice and received no reply. Just goes to prove they worship this lair and crook. Paul also complain to Joe Hunter that I was taken water from the small pond next to my house and would you believe I receive a letter from Joe to stop it. Also Paul told Joe I was putting the lakeashtontalk business card on Golf Carts and again I got a letter from Joe Hunter. But the story doesn't end there, I was in Boston on the day they said I did it. I still have my flight ticket to prove I was not at Lake Ashton. Big Joe Hunter ban me from using the club house for ten days. Poor Joe, I was in Boston for a month. I guess you got your wish. What a bunch of loses. How can anyone believe what this idiot says. What a bunch of idiots and liars. As for Bingo Paul, nothing was done to correct his mistake. I guess Bingo Paul walks on water.

Like most folks in this country, I have a job. I work, they pay me. I pay my taxes & the government distributes my taxes as it sees fit.
In order to get that paycheck, in my case, I am required to pass a random urine test (with which I have no problem).
What I do have a problem with is the distribution of my taxes to people who don't have to pass a urine test.
So, here is my question: Shouldn't one have to pass a urine test to get a welfare check because I have to pass one to earn it for them?
Please understand, I have no problem with helping people get back on their feet. I do, on the other hand, have a problem with helping someone sitting on their BUTT----doing drugs while I work.
Can you imagine how much money each state would save if people had to pass a urine test to get a public assistance check?
I guess we could call the program "URINE OR YOU'RE OUT"!
P.S. Just a thought, all politicians should have to pass a urine test too!

JESSIE STARTED BINGO WITH A LOAN FROM MANAGEMENT OF APPOX. $7000.00. THE LOAN WAS PAID BACK IN TWO YEARS WITH TWO PAYMENTS OF $3500.00.

At that time Paul Pontious was president of the HOA Board. He came on board to oversee Bingo. Slowly he kept asking Jesse how to operate the operations machine. Then he ask how to divide all the money, how to do this, how to do that etc. Before you know it, he knew everything. He even had his name on the Bingo account with Jesse. What a smooth operator. He even had Jesse come in to set up all the chairs and tables and Paul would come around 6:30pm. Before you know it, Paul was calling all the numbers and had taken over as BINGO president. Jesse was doing all the work and Paul was coming in at the last minute doing nothing. Now Paul is telling everyone even the CDD Board how to spend the money. Jesse got sick of Paul telling him what to do and coming in late and doing nothing. Bingo Paul loves to tell people what to do. He is a idiot, make no bones about it.
Jesse started the Bingo game with a loan from the management of (two) $3,500 loans for a total of $7,000. With that, he bought all the equipment for Bingo and got it going. Jesse did all the hard work. He paid back all the loan money in a very short time. Paul Pontious suddenly took over the Bingo game after he told Jesse that a HOA member must be on the BINGO BOARD. MX Attorney has been hired
He was given $5,000 retainer to work on the MX. They tried to get in touch with the developer but he is hiding under his bed. This guy is costing us lots of money and you people are still support him by eating in the restaurant. What is wrong with you all? He is stealing money from all of us and you still eat at his grill. How sick can you get? Wake up and look at the facts. What has he done to help us? Nothing
Margo Stevens is asked to resign
At the HOA meeting she got up and complain about how the MX was worded. Don't you think its just a little late to question the MX, Margo. We all know you voted for the MX. Don't you ever complain about the developer? Yes the developer who hides under his bed and refuses to talk to anyone. I just don't know how stupid one could be. Are you still eating at the developer's restaurant? Why should we help him when he doesn't help us. Margo, please stay with your knitting and resign.

Where is all the Bingo money Paul? I just don't understand your way of thinking. You told your wife when you was president of the HOA that you will never run again. If you lied once you will lied again. You just don't know what you are talking about. Did you know that the Bingo players come in a 4:00 0'clock. What are they doing coming in at 4pm? Paul has about 25 suckers that help this name calling idiot. I just don't know how you got enough votes to be on the committee. There are quite a few of us here that think you are in the same class as Margo Stevens. No change, dumb and stupid. I will be looking right at you at the meeting. I just like to look at dummies.

Bingo Paul just doesn't hear
Bingo Paul just made it on the HOA list. He did nothing, broke the law, Lied, call his enemies Idiots. Walks in billiard room and in front of 20 players and called me an idiot. Arlene Wilson never made it. Arlene just doesn't understand our President. Where was he born Arlene. Where did he get his college money? What did he do as Senator of Illinois? What experience does he have in leading this country? Was he a born an American, is he an American. What job did he have? She knows nothing about our president yet she calls me a liar. Where are his siblings? Arline, I am so glad you lost the election otherwise you would make a fool out of yourself.

Bingo Paul Pontious doesn't get the picture
How dumb can Bingo Paul get. At the HOA meeting today he says there are a few people here who gave him a hard time selling 50/50. Is he really that dumb. It's the state of Florida that says you can't have 50/50 because its a lottery. Only the state of Florida can have a lottery. Paul read the law dumb dumb. You can't sell 50/50 unless your the state. You don't look like the state to me. You look like a dumb dumb you idiot. The HOA also got on your back but Mr nice guy Mr White just keep quite. What a bunch of losers. You guys should hold hands.

There are 8 homes in fore closer here at Lake Ashton. Yes, people here are going thru trouble times. If you can't sell your old home, you should not buy a new one. It is too bad that the sales people can't tell you what it cost to live here at Lake Ashton.
Lake Ashton Lady Gofer Hits another gofer on green
Two women were playing golf. One teed off
and watched in horror as her ball headed directly
toward a
foursome of men playing the next hole. The ball hit
one of the
men. He immediately clasped his hands together at his
groin,
fell to the ground and proceeded to roll around in
agony. The
woman rushed down to the man,and immediately began to
apologize.
"Please allow me to help. I'm a physical therapist and
I know I
could relieve your pain if you'd allow me, she told
him." Oh no,
I'll be fine in a few minutes," the man replied. He
was in
agony lying there in the fetal position, still
clasping his hands
at his groin. At her persistence, however, he finally
allowed
her to help. She gently took his hands away and laid
them to his
side, loosened his pants and put her hands inside. She
tender and artful massage for several long moments and
asked,
" How does that feel"? He replied: " It feels great,
but I still
think my thumb's broken."
