The picture to my right says Carol and Paul. Doesn't he know his name , it's Paul and Carol. Is he hiding behind his wife? Yes Paul, the investigation is still on going. It seems that the Bank records doesn't add up. There appears to be a shortage of over $5,000. Don't worry Paul, we will straighten it out. Maybe we will find out who the idiot is! No, you don't run or own Lake Ashton. You don't tell people what to do or call them idiots or write on people's flyer's "IDIOT". Who in hell are you? I know you and Do Nothing Joe Hunter are good friends, lets keep it that way. You don't have too many friends elsewhere.

How can you steal money from charity and buy things for Lake Ashton without telling anyone? Yes Paul, what happen to the Bingo records prior to January, 2010? My, do we have a short memory. How many friend's do you have now? Can I count them on my hand? Resign from the HOA, and throw in the towel. No one likes a person that steals money from charity. How are you and Frank Ota getting along? He is another guy with a big month. After I help him out with the truck issue he gave me the finger. Both of you are a excellent pair. Double crosses. Letter from Bingo Paul

You may represent some of the residents of Lake Ashton, but in my opinion they really need to move away as all they do is bitch and cause trouble. Not one of them has ever done anything to attempt to make our beautiful committee better. All our, so called, ADHOC Committee has ever done is find fault with anyone who wants to do good for Lake Ashton. Bigger horses asses do not exist on our planet.
Next, I have had nothing to do with the bingo records for several months. You will have to find someone else to provide you records if they are agreeable to do so. We have been under the control of our HOA only since Jan 1, 2010, so the only records covered by the Sunshine Laws will be record as of that date,. all other records will not be available to examine. Of course you might be able to get a year end report that is done at the middle of September and sent in to the Bingo Licensing Center in Bartow.
The Polk County Sheriff's deputy, who is responsible for policing bingo in Polk County received the records he requested several months ago, and has obviously found no problems with the way money as handled or spent. We have never spent any bingo monies for anything other that bingo supplies and equipment. Until Mr. Ralls and associates stopped our 50-50 draws we were able to return that money either to Lake Ashton or to Charity. However, that is all history. I was told we were the only ones to run a 50-50 draw in Polk County, which I find amusing as every organized function I attend in this area has a 50-50 draw. What these jerks did was kill the goose that laid the golden eggs that helped reduce their CDD assessments. Pretty smart planning possibly for someone dumber than a 5th grader.
As far as Dan Perry is concerned, he is well aware that I have very little use for him or his as the wind blows interpretations of various situations. He is the only attorney I have ever dealt with who will normally answer your e-mails within 5 minutes after you send one to him. I don't know, maybe he sits in front of his computer just waiting for an e-mail he can answer. Evidently, he is not extremely busy. Our previous attorney sometimes would take a couple of weeks to research a topic prior to getting back to our HOA Board, I really suspect this was because he was a very busy attorney and had other business to take care of at the time. I also have it on unquestionable resources that it was the GREAT Mr. Perry who caused our bingo group to get rid of the $22,000 that was scheduled by that bingo committee to replace the carpeting in our ballroom at a cost of around $16,000 and to help with several other projects in order to hold CDD assessments in check., So DO NOT try to convince me as to how great mr.perry is as an attorney or as a human being.
I do not have access to records as I previously stated, but have discussed the issue with the person currently directing our bingo, and he also says you will need to number 1, Contact him, and number 2, you will likely need a supeona.
If there was some way that Lake Ashton could keep attorneys noses out of our business, we would all be better off. You people set in your fancy offices and try to find ways to make money off of people who are facing some difficulty. As far as I am concerned, I have met in my 70 years, only 3 or 4 of your ilk that I would trust to work for me. The rest are ambulance chasers, police band listeners, and use any other means to drum up business so you can rip another person or family off.
So please take you request for information on Lake Ashton Bingo and shove it where the sun cannot reach it.
Please feel free to share this message with anyone you wish. I mean every word of what I have included. I have other adjectives that also can be used if this is not clear enough as to where I stand on this issue.

I have just returned from my Northern Home to my Southern Home after being away for 5 months.

I attended the Candidate Forum on Oct 10th. Here are my impressions.

1: I have no attachment to any candidate

2: How could the HOA who did a commendable job in running this event ....permit a ( 4 X 6 ) billboard ... IN THE CLUBHOUSE for 3 candidates, when NO SIGNS ON LA PROPERTY IS PERMITTED ANYWHERE AS STATED IN THE COVENANTS ??

3: I have nothing against Police Officers whether active or retired......HOWEVER....
FORGIVE ME, I WANT MY INVESTMENT LOOKED AFTER BY SUCCESSFUL BUSINESS MINDED PEOPLE....NOT RETIRED COPS. THE WIFE OF THE MAYOR OF LAKE WALES, OR THE WIFE OF..A PRESENT ( HOA BOARD MEMBER ) who I am told is under scrutiny by the law for violations of some kind, while she kept his records.

4: FOR THAT REASON...I WILL PUT MY INVESTMENTS and CONFIDENCE, in the hands of Successful Business experienced people.

5: I will cast my vote for John Chickness, Jo Fuller and Bob Cruz.

6: I expect during my short stay to enjoy the winter, and look forward to the Lake Ashton I invested in to move past its present problems.

The dishonest, untrustworthy, crooks of Lake Ashton has asked the election board in Lake Wales for John Chickness to either remove his sign or add his seat position on the CDD on his poster.. He will add his seat position on his sign to make Brenda Van Sickle, Carol Pointious, and Jake Eaten Happy. Those are the three candidates that are violating the rules of the covenants by placing their information that they are running for the CDD. The Covenants says you cannot place your name on any poster up at the club house.

10 Questions for Jake Eaton (that you won’t see in the LA Times)

  1. It costs the CDD over $100,00 per year to maintain the restaurant (even more this year with plumbing, kitchen equipment, and AC repairs) in the clubhouse. Why, as a resident member on a developer controlled board, did you vote to with the developer to ratify a lease that pays only a fraction of expenses, and then again to extend it?
  2. The boat dock remains on CDD property, with no lease or income to the CDD. Why have you not followed up this issue in any meeting that you have chaired this year?
  3. Last month you stated that you have no investments with the developer, yet in April of 2005 you were telling everyone within earshot what a great deal the developer’s bonds were. What’s the real truth?
  4. The District Lawyer has demanded in writing an explanation from the developer of where a half million-dollar payment to the CDD was spent after Hurricane Charlie. No response was ever received. Why have you not followed up this issue in any meeting that you have chaired this year?
  5. The city of Lake Wales has, by city ordinance, declared that the golf cart paths belong to Lake Ashton residents in lieu of sidewalks. The developer continues to ignore this ordinance, and can sell these paths along with the golf course if he wishes. What have you done to secure these paths for the residents? Why have you not followed up this issue in any meeting that you have chaired this year?
  6. Restaurant assets belonging to the CDD continue to be funneled to the Eagles Nest. Why have you not checked the inventory given to you in 2009 for missing or stolen items?
  7. The CDD pays the developer over twelve dollars an hour for gate attendants. The developer pays just over seven dollars an hour to the attendants. Why do you continually vote to extend a contract that pays a 42% overhead and profit margin?
  8. Last year the CDD received an unsolicited bid for landscape services from the manager of River Ranch that was $100,000 less than the current contract with the developer. Why did you refuse to issue an RFP last year for landscape services fully knowing that there could be a savings of over $100,000?
  9. As a member of the Bingo Committee, records show you had knowledge of the misappropriation of thousands of dollars, yet you did nothing, and now deny any knowledge or complicity. Why?
  10. Why do you constantly advocate doing business with, and preventing competition to, a man who has continually lied to the residents of this community openly and shamelessly, about repairing the roads?

My wife and I come here from Daganesti, Romania because we read in airplane magazine it best place in Florida to retire. I have auto business in Romania and want to go live some place nice with wife for year or two maybe longer. We meet many nice peoples here and ask many questions about USA and much to do here. I see is election here and I ask neighbors what it about and they say it only about money. They say one man here always get all money all time for everything and no one else allowed sell anything or get any money. Is same in Romania I tell him only man in my city have peoples with guns so no one say anything bad about him. My neighbor say peoples here want new man to get moneys so maybe it cost peoples not so much but powerful man have many friends to keep him here all time after election. My neighbor say that in USA it not always same but little people who want win election have hard time against peoples with much moneys. I say I see policeman want to be official and wife of mayor want to be official and wife friend of other man want to be official. In Daganesti all peoples afraid of mayor and police. My neighbor laugh and say they pretty scary here too. I no citizen so I no vote but I think I not vote for peoples who get all money all time before.

Someone took upon themselves to post a fake resume of John Chickness in the Billet room. Have you might have guess, he is running against Jake Eaton the cop. We don't know who did this but we have a good idea who it is, do you?
Paul Pontious will be asked to resign his post on the HOA this Friday. He must resign because he violated the Florida law. We don't need dishonest board members holding a post at Lake Ashton.

Honest Ralf Marino resigns his HOA post.

There is so much corruption at Lake Ashton, thanks to Mr Dave Ross, president of the HOA. He seems to think that shredding the Bingo Files is just plain OK. What the Hell is wrong with this guy? Wake up Mr President, your acting like Bingo Paul. Once a crook always a crook. You can do anything you want and its just OK. Why don't you take action against Bingo Paul? Ralf Marino did the right thing resign. Who wants to be with that band of crooks. Good going Ralf. I tip my hat to you.

Yes, there is correction at Lake Ashton, make no bones about it.

FLORIDA ELECTIONS: CROOKS EVERYWHERE

While our leading politicians use the upcoming elections to fight for the privilege of being the biggest crook of all, the crooks in our community associations use many loopholes in the election regulations of the Florida statutes to fiddle around with elections. The vague language and the total lack of enforcement enable power-hungry board members to do as they please.

The Division of Florida Condominiums, Timeshares, and Mobile Homes has jurisdiction over elections and recalls in condos and homeowners' associations. But arbitration [FS 718.1255] takes forever -- or until the next election -- and the Bureau of Compliance, which only has jurisdictions over condo and co-op elections, is more interested in finding excuses to do nothing than in taking any action to remedy even serious problems.

Recent changes to the election provisions for homeowners' associations [FS 720.306(9)] have done absolutely nothing to improve the election regulations. It still allows sitting board members to do more or less whatever they please.

One of the most common violations: Just not holding elections as required by statutes and bylaws. Both HOA [FS 720.306(2)] and condo [FS 718.112(2)(d) 1.] statutes require annual meetings with elections, a wide majority of governing documents is even more detailed and specify even the month -- sometimes even weeks and/or weekdays -- when the annual meeting with election should take place.

But you can put anything on paper -- it's useless if the folks who should uphold these rules are the ones who knowingly ignore them -- and the folks who should enforce the rules are desperately trying to find excuses for the violators.

The result: Lots of rules -- lots of paper wasted -- but daily life shows that often the people in charge ignore these rules -- because nothing happens to violators anyway.

In many homeowners' associations the boards and management companies willfully fail to give proper notice of the upcoming annual election, resulting in a lack of quorum [FS 720.306(1) requires 30% in person or by proxy] and no new meeting will ever be called.

The quorum requirements are as well used to crash the election. Who counts? I have gotten many complaints from owners who claimed that the clubhouse was filled with owners, no real count was taken, but the board announced that due to lack of quorum no meeting can take place -- and please leave the clubhouse. The sitting board members just helped themselves to another year in office -- without going through the gruesome process of having to defeat an opponent in a real election.

In other cases only the yea-sayers among the owners are invited to the meeting -- not the disgruntled owner who always complain. Where this method is applied, elections result in landslide victories for sitting board members.

The list of ways to cheat is nearly endless -- the loopholes in the statutes are huge and very flexible -- and the professional service providers seem to be only too happy to share their wisdom on how to circumvent the election laws. A happy sitting board guarantees a contract for services for at least another year.

In condominiums you have to find ways around the ability of owners to file complaints with the Bureau of Compliance. But that isn't too difficult, as recent cases have shown.

Remember the Golfside Villas case? CONDO ELECTION -- A CASE FOR EINSTEIN?

Guess what -- nothing ever happened! And the only board member rightfully elected, according to Florida law, was never seated! What does that tell you?

Condo board members, afraid that elections could unseat them, can prolong their term easily for minimum 5 months by plainly ignoring the upcoming election date. Who cares if owners complain and remind the board that the notifications have to be mailed out according to FS 718.112(2)(d)3a? The Bureau of Compliance only takes notice after the fact -- and then you can string them along for quite a while, especially if you know the tricks, like being a licensed attorney. When finally the pressure gets too big and no more convenient excuses are available, you can finally give in and mail out the first election notices (meaning election another 60 days away) -- quite a few months too late -- announcing proudly that you really complied in full with the demands of the regulatory agency.

In the meanwhile it gives you time to take care of "needed" business to make sure that all your friends are taken care of -- just in case the election doesn't go your way. More will have to be said about this case -- with some well-known "players" being involved.

Board members' rule of thumb: You always win; you just have to know how to play the game.

Fair elections -- one of the pillars of democracy -- are clearly not something Florida's leaders are striving for. It's all about money and power. Violating some laws to reach the goal? Who cares! Is that the reason why we see so much corruption -- so many crooks running for office?

But it fits to the reputation of the state that was formerly known as the Sunshine State: FRAUD FRIENDLY FLORIDA!
