Read this note very carefully. I did not
know about the clear button, but I will be
pushing the clear button before I swipe
my gas or debit card and after just to be
safe.
People are getting really desperate due to the
constantly rising gas prices. A friend just told
me about something that happened to one of his
coworkers.She used her credit/debit card to
purchase gas at the pump (like most of us do).
She received her receipt like normal.
However, when she checked her statement, there
were TWO $50 charges in addition to her purchase.
Upon investigation, she found out that
because she did not press the 'clear'
button on the pump, the employee inside the
store was able to use her card to purchase
his/her own gas on her card. To keep this from
happening, after you get your receipt,
you must press the'CLEAR' button or your
information will be stored until the next customer
inserts their card. Be sure to tell all your
friends/family so that this doesn't happen to you!

For the first time in history, the Democratic Congress will not allow an increase in the social security COLA (cost of living adjustment).
In fact, The Henry J. Kaiser Family Foundation predicts there may not be any COLA for the next three years.
However, the per person monthly Medicare insurance premium will be increased from the 2009 premium of $96.40 to $104.20 in 2010 and to $120.20 for the year 2011.
Congress also gave themselves a $3,000.00 a month Cost of Living Adjustment!!!!!
Send this to all seniors and almost seniors that you know, to remind them not to vote for the incumbent senators and congressmen in the 2010 and the 2012 elections.

Felon treasurer no help for community's woes

Homeowners in the North Fort Myers development of Timberbend are concerned about what has happened to the dues and assessments they've paid during the past two years.
And they have good reason to worry.
Their treasurer refuses to respond to homeowner requests for financial records, and the board and homeowners haven't had a meeting in more than a year. And, recently, the homeowners discovered that Teri Bridenthal, the treasurer and registered agent for the Timberbend Property Owners' Association, is a convicted felon on probation for embezzling $1.4 million from a Collier County law firm, according to the Florida Department of Corrections and newspaper accounts.
On Christmas Eve last year, when someone showed Harold Sabin, the former homeowner association president, a copy of a mug shot of Bridenthal, Sabin thought it was fake. It wasn't until he did his own research that he discovered her record.
Sabin said Bridenthal told him she didn't do anything wrong, but he told her it didn't matter.
"If she's a convicted felon, it negates our (insurance) coverage," Sabin said, and she shouldn't be on the board.
Sabin said the issue was compounded when Bridenthal canceled the homeowner's association meeting in January "on advice of counsel" and refused repeated requests to provide copies of the financial records of the association.
The last financial statement was dated April 2007 and came from the management company, Sabin said.
Lawrence Snyder, Sabin's successor on the board, said the management company's contract wasn't renewed and the board took over management of the 80-home site development.
Bridenthal was the secretary/treasurer at the time.
In early 2007, the homeowners association had more than $22,000 in reserves, Sabin said. Association members have since paid about $60,000 in fees and assessments.
The current reserve account, according to a newsletter that Bridenthal sent out recently, was $100. Cash-on-hand was less than $4,800.
"I'm not saying anyone took it," Sabin said. "I'm saying we need to see where it went."
Homeowners can legally compel Bridenthal to turn over the books but will need to hire an attorney if she won't cooperate.
If a majority of homeowners want to recall the officers, they can also do that. And if Bridenthal still refuses to turn over the books, they can ask for arbitration through the state's Department of Professional Regulation, a process that takes on average 63 days.
Meanwhile, the homeowners also received notice of increased association dues for 2010, but some homeowners refuse to pay the $150 dues.
"I'm not paying her any more money until this is resolved," said Lois Fratino, a 10-year resident of the community.
Bridenthal did not return my calls. Neither did association president Donald Robinson.
When Bridenthal was found guilty of embezzlement in 2002, her name was Teri Kim Warren. She was initially sentenced to three years of probation and ordered to pay almost $160,000 restitution to the lawyer she was working for when she took the money.
Bridenthal violated her probation by not making restitution payments and her probation term was extended until 2034, court records show.
Vincent Capriolo has lived in Timberbend for seven years. He said he's not paying his dues for 2010 until he finds out what happened to the $650 he paid as an assessment to correct drainage in the development.
Bridenthal, he said, refuses to tell anyone what happened to the money or if the drainage and erosion problem has been fixed.
I can clear up some of the mystery on this, but I don't think the homeowners are going to like it.
The money they paid apparently did not go to CSA Landclearing, the company hired to fix the drainage issue. According to Lee County Clerk of Court records, CSA put a $26,000 contractor's lien on Timberbend's common property and is suing to foreclose.

Our government should not be immune from similar risks.
Therefore:
Reduce the House of Representatives from the current 435 members to 218 members.
Reduce Senate members from 100 to 50 (one per State). Then, reduce their staff by 25%.
Accomplish this over the next 8 years (two steps/two elections) and of course this would require some redistricting.
Some Yearly Monetary Gains Include:
$44,108,400 for elimination of base pay for congress. (267 members X $165,200 pay/member/ yr.)
$97,175,000 for elimination of their staff. (estimate $1.3 Million in staff per each member of the House, and $3 Million in staff per each member of the Senate every year)
$240,294 for the reduction in remaining staff by 25%.
$7,500,000,000 reduction in pork barrel ear-marks each year. (those members whose jobs are gone. Current estimates for total government pork earmarks are at $15 Billion/yr)
The remaining representatives would need to work smarter and improveefficiencies.It might even be intheir best interests to work together for the good of our country!
We may also expect that smaller committees might lead to a more efficient resolution of issues as well. It might even be easier to keep track of what your representative is doing.
Congress has more tools available to do their jobs than it had back in 1911 when the current number of representatives was established. (telephone, computers, cell phones to name a few)

Charlie's wife, Lucy, had been after him for several weeks to paint the seat
on their commode. Finally, he got around to doing it while Lucy was out.
After finishing, he left to take care of another matter before she returned.
She came in and undressed to take a shower Before getting in the shower, she
sat on the commode. As she tried to stand up, she realized that the
not-quite-dry epoxy paint had glued her to the commode seat.
About that time, Charlie got home and realized her predicament.
They both pushed and pulled without any success whatsoever. Finally, In
desperation, Charlie undid the commode seat bolts. Lucy wrapped a sheet
around herself and Charlie drove her to the Hospital Emergency Room.
The ER Doctor got her into a position where he could study how to free her.
Lucy tried to lighten the embarrassment of it all by saying,
"Well, Doctor, I'll bet you've never seen anything like this before."
The Doctor replied, "Actually, I've seen a lots of them. I just never saw

Just in case you had hoped that our Florida legislature in its infinite wisdom would pass some bills that would help associations/owners deal with the fiscal crisis of unpaid dues and/or bank foreclosures, stop hoping and get prepared for another year with even more unpaid dues and bank foreclosures. All the bills dealing with these issues are dead, successfully killed by the banking lobby and the Republican "leadership".
Owners living in mandatory community associations have to get ready for another year of increased dues and special assessments. Why? Not only because more homes/units will default on their maintenance payments and more homes will go into bank foreclosures, but because the bills that are still in the running in Tallahassee will even increase the cost of doing business for community associations. If these bills are enacted, they will allow service providers to charge even more – and give dictatorial boards the tools to subdue owners even more. It’s obvious that the political leadership in Tallahassee doesn’t care if more families lose their homes and the number of foreclosures increases.

LEE COUNTY: A Fort Myers law firm has filed a class-action lawsuit against a local security company for unfair vehicle booting practices.
Shane Tucker says he was in the wrong place at the wrong time when Whitestone Security booted his truck a few months ago while visiting a friend in a Cape Coral community.
"I thought it was a joke. I was getting ready to cut it off, because I thought it was a joke," he said.
But it wasn't a joke, and it cost him $160 to get the boot off.
Whitestone booted him for parking in the grass, against the homeowner association's rules.
Tucker is part of a class action lawsuit filed on Tuesday that claims Whitestone's booting fines are "illegal" and "nothing more than a profit enhancer."
Last year, Collier County received so many booting complaints, most of them about Whitestone; it capped booting fines to $25.
Ernest Aviles, a former Whitestone employee, claims his boss told him to then focus booting in Lee County.
"He says we're not going to be booting in Collier County anymore, because they passed a $25 fine. We can't work on that amount of money. I want to you come up here, and I want you to kill Lee County. I mean, I want you to hit them hard," said Aviles.
Whitestone denied that claim in February.
"No, that did not happen," said Brian Mayberry, with Whitestone's business development.
Joel Schrock has had a boot on his car since January, not for parking incorrectly, but for an expired tag. Schrock can afford to pay, but he won't out of principal.
"They don't have the law to do that," he said.
His community, Manor at Morton Grove, stopped using Whitestone after residents complained the company booted for things not it its homeowner's association's set of rules.
Whitestone declined to react to the lawsuit, but previously told us it only enforces rules set by homeowner's associations.
The state of Florida has an open investigation into Whitestone, after some residents claimed the company booted vehicles for having expired license plates.
Whitestone says it is not aware of any investigation.

Your own half brother, a devout Muslim, still advocates slavery himself, even though Muslims of Arabic descent refer to black Muslims as "pug nosed slaves." Says a lot of what the Muslim world really thinks of your family's "rich Islamic heritage," doesn't it Mr. Obama?

No one can dispute the pictures shown from all parts of the Muslim world celebrating on CNN, Fox News, MSNBC and other cable news networks that day. Strangely, the very "moderate" Muslims who's asses you bent over backwards to kiss in Cairo, Egypt on June 4th were stone cold silent post 9-11. To many Americans, their silence has meant approval for the acts of that day.

Estero truck owner's tickets pile up

An Estero man feels like he's in the movie "Groundhog Day" when he wakes up every day to find a $25 ticket on his truck's windshield.
So far, the Stoneybrook master association patrol has slapped James W. Sauerwald with about 47 tickets, which totals $1,175, for parking a commercial vehicle in his driveway.
Lee County homeowners' struggle to follow association rules is an unusual byproduct of an economy that has caused double-digit unemployment and home foreclosures.
The golf course community's documents state no commercial vehicles can be parked on the property other than service trucks temporarily there on business.
"We feel like we're getting harassed," said James Sauerwald's wife, Jolie. "They're basically pushing us out of the subdivision."
James Sauerwald parks his work truck in the driveway of his Stoneybrook home in Estero.
Property manager Alexandra Burgher said the rule has been in place since the gated community's inception.
"Ninety-nine percent of the communities have that in their bylaws," Burgher said. "When someone purchases into the community, they are aware that there is a set of rules."
James Sauerwald, 53, an eight-year resident, believes the association should grant him a six-month hardship waiver.
"There are times that you need to bend a little so that people can survive," he said. "The board is not acknowledging the extremely tough times of the construction business."
The Sauerwalds own a small construction business in Naples that's recently downsized from 40 employees to eight.
James Sauerwald said he can only afford one vehicle and he needs the truck because he's out of the office on projects now.
The truck, which has a ladder, doesn't fit in his garage. It doesn't have the business's name on it.
"What would they like me to do? Park it on the outside of Stoneybrook and walk to my house?" he said.
Burgher said the board does not have the leverage to issue a waiver.
"If the board were to have an exception for one, they would have to allow everyone to park their commercial vehicle there," Burgher said.
James Sauerwald has received numerous citations for parking his work truck in his driveway.
"I think that's the No. 1 reason people move into communities. So they don't live in a place where you have trucks parked or commercial vehicles with ladder racks or debris living next to you."
She said the office has gotten complaints about the truck.
"It irritates me to death when people don't follow the rules," said Carol Radde, 66, a seven-year Stoneybrook resident.
"If you can't abide by those rules, then you shouldn't be living in a restricted community."
Burgher said others in the community also have been ticketed for their commercial vehicles.
The Sauerwalds' truck has not bothered Les Gurdin, 67, who lives on the same street.
"I've seen pickups and cars in driveways, nothing of a commercial nature," he said.
The Sauerwalds refuse to pay the tickets.
Burgher said the board could attempt to collect the money in small claims court.
About 60 of Stoneybrook's 1,119 homes, or 5 percent, are in foreclosure, according to real estate agent Jack Mancini.
"They need to be flexible with the ones who are paying their dues and trying to make a living and not foreclose on their home," said Jolie Sauerwald, 48.
"We're to the point where why should we even try and save our home if they're not going to let up on us."

An Estero man feels like he's in the movie "Groundhog Day" when he wakes up every day to find a $25 ticket on his truck's windshield.
So far, the Stoneybrook master association patrol has slapped James W. Sauerwald with about 47 tickets, which totals $1,175, for parking a commercial vehicle in his driveway.
Lee County homeowners' struggle to follow association rules is an unusual byproduct of an economy that has caused double-digit unemployment and home foreclosures.
The golf course community's documents state no commercial vehicles can be parked on the property other than service trucks temporarily there on business.
"We feel like we're getting harassed," said James Sauerwald's wife, Jolie. "They're basically pushing us out of the subdivision."
James Sauerwald parks his work truck in the driveway of his Stoneybrook home in Estero.
Property manager Alexandra Burgher said the rule has been in place since the gated community's inception.
"Ninety-nine percent of the communities have that in their bylaws," Burgher said. "When someone purchases into the community, they are aware that there is a set of rules."
James Sauerwald, 53, an eight-year resident, believes the association should grant him a six-month hardship waiver.
"There are times that you need to bend a little so that people can survive," he said. "The board is not acknowledging the extremely tough times of the construction business."
The Sauerwalds own a small construction business in Naples that's recently downsized from 40 employees to eight.
James Sauerwald said he can only afford one vehicle and he needs the truck because he's out of the office on projects now.
The truck, which has a ladder, doesn't fit in his garage. It doesn't have the business's name on it.
"What would they like me to do? Park it on the outside of Stoneybrook and walk to my house?" he said.
Burgher said the board does not have the leverage to issue a waiver.
"If the board were to have an exception for one, they would have to allow everyone to park their commercial vehicle there," Burgher said.
James Sauerwald has received numerous citations for parking his work truck in his driveway.
"I think that's the No. 1 reason people move into communities. So they don't live in a place where you have trucks parked or commercial vehicles with ladder racks or debris living next to you."
She said the office has gotten complaints about the truck.
"It irritates me to death when people don't follow the rules," said Carol Radde, 66, a seven-year Stoneybrook resident.
"If you can't abide by those rules, then you shouldn't be living in a restricted community."
Burgher said others in the community also have been ticketed for their commercial vehicles.
The Sauerwalds' truck has not bothered Les Gurdin, 67, who lives on the same street.
"I've seen pickups and cars in driveways, nothing of a commercial nature," he said.
The Sauerwalds refuse to pay the tickets.
Burgher said the board could attempt to collect the money in small claims court.
About 60 of Stoneybrook's 1,119 homes, or 5 percent, are in foreclosure, according to real estate agent Jack Mancini.
"They need to be flexible with the ones who are paying their dues and trying to make a living and not foreclose on their home," said Jolie Sauerwald, 48.
"We're to the point where why should we even try and save our home if they're not going to let up on us."

Paul Pontious
Yesterday March 22, Paul drove by my house and again shouted at me and gave me the finger. Does he expect me to stand by and do nothing, but to take his insults. I have E-Mail Joe Hunter and he has done nothing. I have now taken steps today to file criminal charges against Paul Pontious with Bingo. He stole the game from Jesse with lairs and now he is insulting me. I will follow up with this story in the coming weeks. He has violated the Florida law and he his blaming me. How stupid can one be. I helped him by telling him but I guess he just doesn't understand.

Air Force One Crashed....
Air Force One crashed in the middle of rural America . Panic stricken, the local sheriff mobilized and descended on the farm in force.
When they got there, the disaster was clear. The aircraft was totally destroyed with only a burned hulk left smoldering in a tree line that bordered a farm. The sheriff and his men entered the smoking mess but could find no remains of anyone, including the President.
They spotted a lone farmer plowing a field not too far away as if nothing at all happened. They hurried over to the man's tractor. "Hank," the sheriff yelled, panting and out of breath. "Did you see this terrible accident happen?"
"Yep. Sure did." The farmer mumbled unconcernedly, cutting off his motor.
"Do you realize that is the airplane of the President of the United States?"
"Yep."
"Were there any survivors?"
"Nope. They's all kilt straight out" the farmer answered. "I done buried them all myself. Took me most of the morning..."
"President Obama is dead?" the sheriff shouted.
"Well," the farmer grumbled, restarting his tractor.
"He kept a-saying he weren't ... but you know what a liar he is."

The American people inaugurate a half-Arab president with a total of 142 days experience as a US Senator from the most politically corrupt state (city) in America whose governors have been ousted from office. The President's first official act is to order the close of Gitmo and make sure terrorists civil rights are not violated. (honest mistake?)
2. The U.S. Congress rushes to confirm a black Attorney General, Eric Holder, whose law firm we later find out represents seventeen Gitmo Terrorists. (An honest mistake?!)
3. The CIA Boss appointee, Leon Panetta, has absolutely no experience, has a daughter Linda, we find out, who is a true radical anti-American activist and a supporter of all the Anti-American regimes in the western hemisphere. (There were socioeconomic factors involved!)
4. We got the second most corrupt American woman (Pelosi is #1) as Secretary of State; bought and paid for. (You can put lipstick on a pig, but it still stinks!)
5. We got a Tax Cheat for Treasury Secretary who did not properly file his own taxes for 12 years. (He misspoke!)
6. A Commerce Secretary nominee who withdrew due to corruption charges. (Another honest mistake???)
7. A Tax cheat nominee for Chief Performance Officer who withdrew under charges. (Hmmm... Another screw-up?)
8. A Labor Secretary nominee who withdrew under charges of unethical conduct. (Ok, maybe this person was just plain stupid.)
9. A Secretary HHS nominee (Daschle) who withdrew under charges of cheating on his taxes. (I'm running out of excuses for these idiots!!)
10. Multiple appointments of former lobbyists after an absolute campaign statement that no lobbyists would be appointed. (Dear God, I am getting a headache!)
All this occurred just during the first three weeks. . . But who's counting? America is being run by the modern-day Three Stooges ; Barry, Nancy and Harry and they are still trying to define stimulus..."it's spending!!!" The congress passes the $800,000,000,000 (that's $800 billion) pork-loaded spending bill where the government gives you a smidgen of your tax dollars ($13 per week), making you feel so good about yourself [stimulated], that you want to run out to Wal-Mart and buy a new Chinese-made HDTV and go home and watch Telemundo! Pray for our country.
Here's the good news though - Obama took Air Force One to Denver to sign the stimulus package, wasting as much as 10,000 gallons of fuel OR 24 JOBS FOR ONE YEAR. Don't you just love hypocrites?
Obama went to the International Olympic Committee to have them choose Chicago for a host city, he failed.
Obama went to Copenhagen to lecture them on global warming, he failed.
Obama went to new Jersey to promote the Democratic candidate for governor, he failed,
Obama went to Virginia to promote the Democratic candidate for governor, he failed.
Obama went to Massachusetts to promote the Democratic candidate for senator, he failed.
Speaking of praying, Obama has now been president for a full year and yet he & wife (first lady) Michelle, the Christian family they claim to be, have not attended church since the inauguration.
Obama is the 1st president in history who did not attend any Christmas religious observance. He must miss Reverend Wright!
And finally, he is the 1st president to remain on vacation after a terrorist attack. In these times 'I'll keep my God, my freedom, my gun and my money.

Bingo new expense
They have hired another security gate attendant for Monday night Bingo. The residents of Lake Ashton are paying for this cost just so Bingo Paul's Customers will get there on time. Why should we pay for Bingo's entertainment? Joe Hunter also had a saying in this matter. What ever Paul wants he gets, thanks to Joe Hunter. Yes, there are now two security guards at the gate.

Joseph Prudente, 66, of Bayonet, Fla., was jailed after his adjustable-rate mortgage reset and forced him to make what he thought was a no-brainer of a decision: pay the extra $600 a month and replant the lawn later.
But that prompted his homeowners association (HOA) to bring charges against him, ultimately landing him in the slammer until neighbors banded together and bailed him out with cash for new landscaping.
Never promised a rose garden of the size he wanted, Jeffrey DeMarco, formerly of Rancho Santa Fe, Calif., lost his home when he planted too many bushes and re-graded the four-acre property in violation of his homeowners association's rules.
In addition to foreclosure, he got stuck with the association's legal fees: $70,000.
Homeowners association rule enforcement can be so notorious it was once lampooned by an episode of the old "X-Files" television series. The episode's HOA president conjured up a Tibetan monster to eat association residents who didn't toe the line.
HOA rules can really bite, so how is it that the vast majority of the 60 million people who live in the nation's 350,000 HOA communities are happy with their lifestyle?
"Conflict and dissension make headlines, and that's what many Americans read in newspapers and see on television about community associations," Thomas M. Skiba, CEO of Community Associations Institute (CAI), said in a statement. "But when you ask residents themselves, the news is largely positive. While there are serious issues in some communities, this research affirms that vast majority of homeowner board members and professional managers are doing good work for the community associations they serve."

Only 12 percent of community association residents expressed some level of discontent with their communities, according to recently released research commissioned by CAI.
The vast majority, 71 percent, said they are satisfied with HOA life, and 17 percent said they were neither satisfied nor dissatisfied with their communities.
Buying a home in an HOA community is a lot like buying a share in a closely held, publicly traded real estate holding company governed by an ever-changing regulatory system and managed by volunteers -- your neighbors.
The associations are typically self-governed communities managed by a board of directors (typically residents who volunteer), with the help of a management company. Together they oversee finances, maintenance, day-to-day operations, the by-laws and the rules. Those rules typically address issues such as architectural guidelines, common area use, pets and parking.
Homeowners associations have seen their share of shoddy construction leading to nasty building defect litigation as well as poor management and disgruntled residents, but most residents are quite satisfied with how they operate.
Nearly 90 percent of residents say board members either "absolutely" or "for the most part" work to serve the communities' best interests. Only 7 percent expressed displeasure with their boards. An estimated 2 million homeowner volunteers serve on the boards that govern associations.
The communities range from townhomes and cooperatives to high-rise condominiums and city-size master-planned associations. Most residents have heard the horror stories about HOA living but don't choose to participate without careful consideration.
The type of housing often is relatively more affordable than a single-family detached property and, most residents believe, the rules benefit home values.
Zogby's telephone survey for CAI conducted in December found that 70 percent of HOA residents surveyed said the rules "protect and enhance" property values. Only 2 percent said the opposite and 27 percent said the rules have no impact.
Other findings include:
* Eighty-two percent said they get a "good" or "great" return on their association assessments or dues. In addition to a mortgage, HOA residents typically pay a monthly assessment to fund the association's operations and services, including landscaping, maintenance, garbage pickup, snow removal, street lighting, pools, club houses, tennis courts, playgrounds and association-sponsored social functions.
* Seventy-six percent say management companies provide value and support to residents and the association at large.
* Residents say the best aspects of HOA living are neighborhood attractiveness (23 percent), less maintenance for individual homeowners (22 percent), community safety (13 percent) and property values (11 percent).
* When asked about the worst aspects, 37 percent of residents said there were none. Fourteen percent mentioned restrictions on exterior improvements, followed by dealing with neighbors (12 percent) and paying assessments (10 percent).
Previous studies have revealed similar findings.
"Americans have weathered difficult times, and that would normally create more negative views toward most institutions," Lincoln Hobbs, a member of CAI's College of Community Association Lawyers and president of CAI's affiliate Foundation for Community Association Research, said in a statement. "That hasn't happened in the case of community associations. That says a lot about the dedication and skill of the vast majority of homeowner volunteers and professionals who govern and manage these communities."

Desperate times call for desperate measures -- right? I have no other explanation for the CAI (Community Associations Institute) publishing this pathetic push poll. Community associations file for bankruptcy and/or can't pay their bills any longer; owners are losing their homes because neighbors don't pay their dues and town halls are full of owners complaining about all kinds of problems in their community associations -- ranging from serious budget deficits to having the buildings red-tagged by the health department because the water was turned off due to the association's failure to pay the water bill.
Great timing for the CAI to use such a push poll to declare that everything is well in the community association La-La-Land.
Being German and knowing my history, I am reminded of the desperate attempt of Adolf Hitler having his Propaganda Minister Joseph Goebbels explain to the German people that the defeat of the German army in Stalingrad was actually a victory!
This time the CAI press release didn't even mention how the participants were selected and how many were actually polled. Most likely they asked the same CAI members as in the last polls.
I can only imagine the public outcry of CAI members if I would publish a poll asking 1000 pre-selected owners how they feel about the system called "community association," the service providers and what they really think about the volunteers called board members.
I could easily get results of 97% dissatisfaction, just by asking a few board members who are members of the CAI providing the 3%.
To be very honest, publishing such a push poll is in my opinion more damaging to the reputation of a trade organization than silence, especially since their lobbying efforts show that they are unwilling to lobby for reforms that would actually help associations to deal with the multitude of problems. Every person in his right mind would doubt the credibility of an organization publishing such a tainted poll.
