Interpretation of Dan Perry's letter on May 20, 2010
This is the 2nd file where Dan Perry writes to the HOA BOD. In this correspondence D Perry clearly recognizes that the HOA has had FULL oversight, control and was responsible of ALL Bingo operations, legal or illegal.
D Perry further goes on to highlight that the HOA BOD did NOT want to draw attention to the fact that Paul Pontious may come under a formal investigation while he was running for a HOA BOD seat. I am not a lawyer but sounds like collusion to me and the fact that D Perry seems to support the decision by the HOA BOD to ‘hide” the truth behind this issue, since D Perry does not advise that such an act (hiding the fact of mishandling of Bingo operations and its monies as well as the potential of criminal acts) could be perceived as collusion.

Again I am not a lawyer or claiming that this was done by anyone, it just ‘appears’ that by intentionally hiding the fact that there were mishandling of Bingo monies on behalf of Paul Pontious and the HOA BOD, in order to get Paul Pontious elected, seems odd to me and I would think the community would be very surprised by the fact the HOA BOD is misleading them on this issue. If they (HOA BOD) are willing to mislead us on such a major issue, what else are they will they mislead the community on? I guess that is why the HOA BOD is working so hard to suppress any further discussion on this issue.
Attached is D Perry’s suggested draft of the HOA BOD dissolve their relationship with Bingo, of which was never submitted. Why? Because the HOA BOD decided to follow D Perry’s legal advice to ‘allow’ this issue to “temporarily die” within “…the Community than open yourself (Dave Ross and BOD) to being the subject of an expanded criminal investigation by law enforcement…”
Seems that the lawyer, Dan Perry, clearly recognized that a very thorny legal issue was on the horizon with the result of several being held accountable and advised the HOA BOD to conceal this issue in effort to allow the community to forget or be subject to a misinformation campaign that intentionally misinformed the community as to what really was going on.
If this is in fact true, then as Ricky Recardo would say “… someone has some splain to do..”

I encourage all residents to read this letter and then ask the HOA Board as to the name, address and phone numbers and a copy reports, of both the lawyer they used as well as the account, who did 'their' so-called investigation. Do not be surprised when the HOA refuses to respond to your request or provide this information. What ever the HOA does on 'our' behalf IS public information so requesting this information is a legitimate request.

How does Dave Ross, and HOA board explain this email? Do they just ignore it ? Here the HOA Attorney is stating , HOA will have nothing to do with PAUL PONTIOUS. Complete removal . Cut the Ties.

Paul Pontious
I just can't bare looking at Paul Pontious knowing he kept all the charity money for himself and his friends, accusing Jesse of stealing the excess bingo money when he left, and here I am putting on shows for charity, with all my time and my expenses. The other day I walked into Public's, there was a lady ringing her little bell with a sign over her shoulder that said Salvation Army. Before I even got close I took out my wallet and placed a dollar in the pail and Nancy was closed behind me and she did the same. It may be a little donation but we go there very often. I'm sorry, I just can't forgive a man like Bingo Paul Pontious spending it on himself. I am glad he was not the guy that was ringing that bell. He is a educated man with a collage degree , there is no excuse for what he did. I am sad, very sad that the HOA had not removed him from Bingo. The old saying goes, once a crook always a crook. Dick Ralls who is president of our committee along with John Guenther, Rich Earl, Bab Salvin, John Chickness and I, Edmund King and others Donated money to investigate the Bingo being played here at Lake Ashton. Over $2500 plus was used to obtain all Bank Records of Bingo Paul and Bingo, all 4 of them. I would very much rather give our money to charity then to hired forensic accountant attorney's. I'm sorry, you people may love him but he has given us a very bad name to this community. And you talk about prices of homes going down, you can thank him. We have all the records of all the checks he wrote so he can't say No I didn't do that. Sorry Paul, you are in deep trouble and you know it. Is that the reason you destroyed all the Bingo records. Your wasted your time. I just can't believe you still have friends that believe in you. How long can you lie and how long will all your friends trust you. Our goal is to make Lake Ashton a honest and clean community. I just can't believe some of the dirty looks I am getting, people that believe in Paul Pontious, they have to be mentally retarded.

Interpretation Jan 4, 2010 letter from Ron White
Contained within the 4 Jan 2010 email from Ron White (who was a HOA BOD member at the time) writes to fellow HOA BOD members, and expresses his concerned that, whatever was discussed / agreed upon in a previous meeting with HOA BOD, Mr. Pontious and Mr. Perry, that suddenly, “Paul” ( Paul Pontious) is backing out of “the agreement”, and now threatening to stop running Bingo, IF he (Paul Pontious), is unable to continue to control Bingo and its funds.
Remember, the HOA BOD had, only a short time earlier, publicly stated that effective 1 Jan 2010, that they ‘now and for the first time every’, “they” (HOA BOD) were officially taking over all Bingo operations.
Ron White further annotates a motive behind Paul Pontious continued desire to maintain control over Bingo and is funds, in conjunction with Paul Pontious desire to run for a seat on the HOA BOD. It appears that Mr. Pontious understood that IF the facts of this issue came to light with the Lake Ashton Residents, he may not get elected to the HOA BOD.
Keep in mind this 4 Jan 2010 email, particularly when you read a email four months later from Mr. Dan Perry, dated 20 May 2010, who is the lawyer for the HOA and by proxy, the lawyer that is supposed to be representing the best interest ALL Lake Ashton Resident.
Look for the next posting whereby you can read for yourself, how in a 20 May 2010 email from Mr. Perry to the HOA BOD, acknowledges that the HOA BOD has ALWAYS had legal responsibility for Bingo and all of its operations and the handling of monies. Mr. Perry continues on in this email to support the HOA BOD desire to NOT to disclose to the Lake Ashton Residents, that there are grounds for a criminal investigation IF this issue gets into the hands of law enforcement, AND further endorses the desire of the HOA BOD to withhold this information (conceal) of a very serious legal predicament in order to not only help Mr. Pontious get elected to the HOA BOD seat as well as protect the HOA BOD from being subject to an expanded criminal investigation by law enforcement.
As a Resident of Lake Ashton, wouldn’t like to know if a serious legal situation PRIOR to voting Mr. Pontious to the HOA BOD?
How about that Mr. Pontious apparently agreed to a previous agreement which called for him to step down and to no longer have ANY further dealings with Bingo, its monies or its operation, only to have a change of heart and decided to further place the HOA BOD in an awkward position, what appears and effort to black mailed the HOA BOD into keeping him running Bingo as well as, (you will see in the 20 May 2010 email by Mr. Perry) to conceal the entire pending legal issue in to ensure he, Mr. Pontious, was elected into office.
The reason why I used the word black mail, is because the HOA BOD has ALWAYS known that the HOA ultimately had the legal responsibility regarding the operation of Bingo and all its aspects, and, it appears Mr. Pontious threatened, suggested, or implied, to the HOA BOD that if he went down, he’d take the HOA BOD and others down with him. Think about it, why else would the HOA BOD conspire to withhold this damning information? If the HOA BOD in fact never had a legal responsibility, as ‘they’ now claim, why then make a conscious decision to conceal all of this from the Residents? Confused? So am I.
Don’t take this writers opinion on this issue but discern for yourself as you read the unfolding following correspondence on this issue. Doesn’t all of this just give everyone a warm fuzzy that the HOA BOD has YOUR best interests at heart?
Please, do not take this writers opinion, but do your own due diligence and discern for yourself, and see if you too, come to the same conclusion or opinion.
