Dave Ross Revised

Because of David Ross unfounded remarks noted in the letter below and the fact that he said that all Bingo accounts has been closed and turn over to the HOA committee, and all Bingo records have not been destroyed and are still in the hands of Bingo Paul or the HOA, this is all a big lie. One account still remains open and the Bingo records has been destroyed. No taxes were ever paid to the state or the feds. No charity money was given to any charity. In fact the money was used to take everybody s friends out to dinner. Is Dave Ross revising the Bingo Law? Dave Ross doesn't know the difference between the truth or a lie. Why is he covering up for Paul Pontious? Is he involved in this crooked scam of taken charity money from the Bingo players and taken all his friends out to dinner by way of a chartered bus. We all know he and his wife and all the HOA members were taken out to a high price steak house. You would think he should know that this extra money from Bingo should go to charity. Yes, he is has guilty has Paul Pontious for stealing money from charity.

Now we have this Dewinkler guy running Bingo. He doesn't know how to add or subtract. Paul is still running Bingo and doing the bookkeeping on all the books. You should hear this Dewinkler guy talk, he sounds like he is still in kindergarten. Where in hell did they find this guy, on the side of the road?

On January 28, 2011 a hearing will be held at the Bartow court house at 8:0' clock. Dave Ross seems to think that his lawyer can easily dismiss this case. Is he crazy? Everything he said at the meeting was a sad case of mistakes. He screwed up the elections by having it at the wrong time when most everyone was still on summer vacation. Let it be known I will be there for Dick Ralls. This guy has the guts to stand up to a lair and a dishonest person that doesn't know the truth when he sees it. Dick wants his money back. Dave Ross must resign, he doesn't tell the truth, he doesn't know the truth, and he sends out letters that are totally misleading and not the truth. We had two members of his committee that resign. Dave must follow suit and resign. Dave Ross is a disgrace to this community.

This Bingo Paul case is so complicated that its like watergate, so many people are involved and may even involved Jack Van Sickle, Joe Ferreira, and Wesley Pahi. Carol Pontious, the bookkeeper is totally involved. She and her husband Paul work has a team.

Paul,

Barbra has asked me to explain your statement regarding the two separate bingo accounts.

If you would spend less time running your filthy mouth and had any concern of the law of the land, you would know that an activity that runs simultaneously with a charitable activity, and serves no other purpose, is considered to be enjoined with that activity. The only purpose of having two accounts serves only you and your gang.

As usually, you are attempting to disguise your misuse of bingo funds. Per the Statute, with only a few exceptions, all the monies you have misused or stolen from the homeowners, our community and the HOA, was illegal and served you and your gangs purposes only. Until January 2010, not one dime from the bingo accounts, was given to any charity. Since January 2010, in excess of $5,000 dollars of bingo monies has been spent on bribes, to the HOA, CDD, the Mayor and your gang.

Your statement regarding your removal from the bingo board is a lie. While it is true that in name/title, you are no longer officially running bingo activities, it is fact that you continue to run most aspects of this activity. A homeowner would have to be deaf, dumb and blind, to believe your statement that you no longer have any vested interest in bingo activities.

Barbra’s time, as apart of a group, has been spent working to remove the carpetbaggers, such as your self, from this community.

Show me a group, other than yours, who has tried harder and has been more successful in rapping the community and its homeowners, of funds that should have gone to charity and the HOA who is ultimately responsible for bingo funds.

Paul, Barbra’s so called gang of cut throats main intention is to rid the community of the group of carpet baggers, your group being one, that has stolen, lied, cheated, has deliberated mislead the residents regarding the condition of the roads. The road issue alone will cost this community millions of dollars and no one can offer a legitimate reason as why this was done.

Paul, Barbra is living in the community that she wants to live in. You, on the other hand, are in the process of having your bank records, personal records, and your bingo records subpoenaed with an arrest warrant about to be issued. My advice is take your own advice: give your home away immediately, move your residence back to the UP were which at least you will be on par with the other mental midgets, and then hope that the heat blows over.

Paul, regarding your statement pertaining to you and Carol, the only thing you have done to this community has ruined its reputation, stolen money from charity and this community, and made fools of yourself, your wife and the community. I have never known a piece of crap such as yourself, who would subject his wife to the same prosecution that you will be facing.

You can prove to your group of morons how straight up a guy you are by going to your attorney and filing a liable / slander suit against me forth wit. This will prove that you at least think the stuff that spews from your month could possibly be true. By not filing a suit, you will prove that you are just a tired old blow hard that has taken this community for a ton.

Civil court ruling fuels Sun 'n Lake controversy

SEBRING - Factions affected by a civil suit in Sun 'n Lake of Sebring Improvement District had differing interpretations of a judge's ruling that found in favor of the Property Owners Association of Sun 'n Lake of Sebring Inc., regarding the 2009 election.

One side said the Oct. 5 court ruling questioned the legality of 2,022 votes cast by a large landowner, National Recreational Properties Inc., (NRPI), which swayed the course of the 2009 landowners election and reelected Incumbent Supervisor Frank Guglielmi.

The Improvement District's Attorney John McClure said all Circuit Judge Angela Cowden's decision meant was that NRPI could not vote in any future election.

Judge Cowden found in favor of the property owners because NRPI did not respond or plead in the civil action and was therefore in default.

"The clerk of this court entered a default against (NRPI) on March 4, 2010," Cowden wrote in her decision. "When a default is entered against a defendant, the court should take all of the plaintiff's allegations as true."

The civil suit was filed by local attorney Gary Gossett on behalf of the POA on Jan. 16, 2009 and asked the court for its permanent injunctive relief to apply to the Jan. 23, 2009 election as well. But the final ruling came more than a year after the election.

According to McClure, the court's decision was not retroactive to the 2009 election and had no legal affect on anything that's already taken place.

He said he knew of no pending litigation or any court ruling in that regard.

"The court did not rule that any prior election was invalid or that their votes were improperly cast in anyway," he said.

Supervisor Dick Miller, who lost to Guglielmi in 2009, but was elected to a popular seat in November, said Tuesday that he didn't entirely accept McClure's interpretation of the ruling.

"The fact is pretty simple, if proper procedures had been followed the outcome would have been quite different," Miller said. "What we've got here is really a moral or ethical situation.

"I will not attempt to change the legal outcome of the election. If I was in that position I'd have to ask myself on what basis do I serve? The point is you had a supervisor elected who shouldn't have been elected based upon the legalities of that time."

In the lawsuit the POA alleged that a controversy existed between it and NRPI over the mega-landowner's right to cast its more than 2,000 proxy votes in a landowner election.

POA President Larry Stange believed the ruling showed NRPI wasn't legally able to vote because they hadn't paid up their assessments in full.

"NRPI paid one year's assessment, but in order to vote they would have had to pay the furthest back first to get caught up," he said. "So they weren't legal to vote; so we won."

The suit also stated that the district's files were not properly maintained, including three differing versions of an important document regarding NRPI's right to vote, one signed, one partially signed and one unsigned, so the controversy could not be readily resolved.

But, NRPI voted in the January 2009, landowners' election giving its 2,022 votes to Guglielmi.

Therefore, Stange maintained Tuesday, that Guglielmi was not legally elected and should not sit on the board of supervisors.

According to a previous report, in that race Guglielmi received 2,658 votes, and edged out Dick Miller, with his 1,514 votes by a margin of 1,144 votes.

What happens next is up to the board of supervisors, Stange said.

Supervisor Frank Guglielmi said Wednesday that he had no intention of stepping down from the Sun 'n Lake Board of Supervisors. This issue has been going on since 2008, he said.

"Why do they keep pushing this," Guglielmi asked? "What are they trying to achieve? NRPI's votes were legal. They tried to get me off the board, but they're not going to do it. These guys don't want me on the board because it doesn't fit their agenda.

"I'm tired of this nonsense. I was legally elected and I'll never resign. I've got two more years on my term. I'm not going to resign."
