On Nov. 9, 2010, our complaint against the County of Polk for an exemption from ad valorem taxation was heard in the Tenth Circuit Court. The complaint was filed for the 2009 and 2010 tax years. Our counsel, Rob Bradley, was well prepared and George Flint was excellent as an expert witness for the District. On Nov. 16th, Judge Raiden found in our favor, in that, the properties involved in this action (facilities owned by both Lake Ashton (Lake Wales and Winter Haven) CDD's) are exempt from ad valorem taxes. The County Property Appraiser has ten business days to appeal this judgment.

The ruling does not apply to residential dwellings.
