Prosecutors filed charges against eight Miami-Dade residents in an alleged mortgage fraud scheme at Jade condo.

Federal prosecutors charged eight Miami-Dade residents in a multi-million dollar mortgage fraud scheme that spanned November 2004 to September 2009 at Jade, a luxury downtown Miami condominium.

  
Charged in a federal indictment with conspiracy to commit mail fraud were Andres “Andy’’ Mendez Sr., 47, and Andres “Andy’’ Mendez Jr., 26, both of Miami-Dade; Lilia Casal-Diaz, 42, a Coral Gables attorney; Ayadie Carmen Londono, 59, a former real estate broker from Miami; Josephine Santana, 57, a mortgage broker of Miami-Dade; Jose Rafael Martinez, 36, of Miami-Dade; and Basilio Gomez, 52, of Miami-Dade. The indictment seeks forfeiture of ill-gotten gains, including $5.7 million. 

  
Charged separately by a criminal information was Raquel de Jesus Martinez, 49, of Miami. Martinez, a title agent, faces charges of conspiracy to commit mail fraud and money laundering for her alleged role in creating false paperwork in return for kickbacks. 

  
Prosecutors said the defendants made an initial appearance in U.S. District Court in Miami Tuesday before U.S. Magistrate Judge Jonathan Goodman. 

  
According to court papers, the defendants used straw buyers to buy units at the 1331 Brickell Bay Drive condo, submitting false information to lenders to get loans in excess of the actual sales price on the units. Two sets of loan papers were used: One provided to the sellers that showed the actual sales price and another provided to lenders showing inflated sales prices, the prosecution alleges.
Another defendant, Jose Arnaldo Rosario, 55, of Miami-Dade was sentenced Aug. 5, 2011 to 46 months in prison for his role in the alleged scheme. Rosario pleaded guilty to conspiracy to commit money laundering and wire fraud. Prosecutors said he provided false information to lending institution and got kickbacks in the purchase of two apartment units.

One of the last remaining sand dunes on Fort Lauderdale beach has been destroyed.

Despite objections from environmental activists, a judge allowed the Mayan Beach Club and Ocean Lane Villas to destroy the dune after residents complained it was blocking their view of the ocean.

After a lengthy legal battle, a state judge ruled that removal of the sand mound on Fort Lauderdale's southern beach would not constitute a "take" of marine sea turtles and that a permit should be issued for removal.

"It was disappointing because we felt the ruling of the judge and processing of the evidence was more political and catered to coastal companies," said Richard Whitecloud, founder and director of the turtle rescue organization Sea Turtle Oversight Protection, which filed an exception to the ruling in an effort to save the dune.

Activists warned that the sand dune helped to protect against erosion and also served as a habitat for nesting sea turtles, but their efforts fell short.

"The disappointing part is the judge's interpretation of what is and isn't empirical science," Whitecloud said.

Attorney Alessandra Stivelman of the law firm Eisinger, Brown, Lewis, Frankel & Chaiet P.A. said the circumstances of obstructed-view cases vary, making it difficult to predict how the ruling could impact future beach property issues.

Because the dune is a nesting habitat for turtles, the Florida Department of Environmental Protection called on both associations to prove that the environmental impact would not be significant. The associations were required to wait until after turtle nesting season ended.

"If another condo association had the exact same issue, they're still going to have to go through the procedural hurdles," Stivelman said.

As Fort Lauderdale continues to deal with beach erosion just north of Sunrise Boulevard and A1A, Whitecloud said sand dunes that provide vegetation are the city's best bet to prevent more erosion. He said dune restoration should be part of any beach renourishment project.

Whitecloud cited the beach along the Galt Ocean Mile in Fort Lauderdale, which has a number of high-rise condominiums just north of Oakland Park Boulevard and A1A, as a beach area that has seen significant erosion since Hurricane Sandy struck.

"Hopefully Hurricane Sandy provides a wake-up call and is a red flag for coastal communities that the ocean is going to continue to eat away at the beach," he said. "Dune restoration can help prevent that."

$560,000 Embezzled From Condo Associations, Authorities Say

The 45-year-old chief financial officer at a Tampa Bay realty company faces a first degree grand theft charge for allegedly stealing $560,000 from 10 beach condo associations. (The associations are listed below.)

Roberto Martin Velez of Seminole had been working as the chief financial officer for Total Realty Services, according to the Pinellas County Sheriff's Office, when he allegedly embezzled the money from the condo associations and his employer.
Authorities allege that Velez stole the funds over the past three and half years.
In his CFO position, Velez managed the transfers of funds from the condo associations to Total Realty Services.
After the funds reached his employer, he would transfer money to himself with checks and electronic payments, authorities say.
The Sheriff's Office was tipped off about the possible criminal activity when it launched the investigation.

According to authorities, Velez and the Total Realty Service accounts were investigated. Incriminating evidence was found against Velez.

The time was 1940. America was still in a terrible economic depression. Hitler was taking over Europe and Americans were afraid we'd have to go to war. It was a time of hardship and worry for most Americans.

This was the era just before TV, when radio shows were HUGE, and American families sat around their radios in the evenings, listening to their favorite entertainers, and no entertainer of that era was bigger than Kate Smith.

 

Kate was also large in size, and the popular phrase still used today is in deference to her, "Ain't over till the fat lady sings". Kate Smith might not have made it big in the age of TV, but with her voice coming over the radio, she was the biggest star of her time.

Kate was also very patriotic. It hurt her to see Americans so depressed and afraid of what the next day would bring. She had hope for America, and faith in her fellow Americans. She wanted to do something to cheer them up, so she went to the famous American song-writer, Irving Berlin (also wrote "White Christmas") and asked him to write a song that would make Americans feel good again about their country.

 

When she described what she was looking for, he said he had just the song for her. He went to his files and found a song that he had written, but never published, 22 years before - way back in 1917. He gave it to Kate Smith and she worked on it with her studio orchestra. She and Irving Berlin were not sure how the song would be received by the public, but both agreed they would not take any profits from God Bless America. Any profits would go to the Boy Scouts of America. Over the years, the Boy Scouts have received millions of dollars in royalties from this song.

This video starts out with Kate Smith coming into the radio studio with the orchestra and an audience. She introduces the new song for the very first time, and starts singing. After the first couple verses, with her voice in the background still singing, scenes are shown from the 1940 movie, "You're In The Army Now." At the 4:20 mark of the video you see a young actor in the movie, sitting in an office, reading a paper; it's Ronald Reagan.

 

Frank Sinatra considered Kate Smith the best singer of her time, and said when he and a million other guys first heard her sing "God Bless America" on the radio, they all pretended to have dust in their eyes as they wiped away a tear or two.

To this day, God Bless America stirs our patriotic feelings and pride in our country. Back in 1940, when Kate Smith went looking for a song to raise the spirits of her fellow Americans, I doubt she realized just how successful the results would be for her fellow Americans during those years of hardship and worry, and for many generations of Americans to follow. Now that you know the story of the song, I hope you will enjoy it and treasure it even more.

Do you have a gun in the house?

GOOD TO KNOW! When I had my gallbladder taken out and spent 10 days in the hospital for what should have been an overnight stay the insurance company kicked me out. I had home nurse visits for two weeks and was asked if I had guns in the house. I respond that if I did I would not tell them. So the below has some merit. FYI, I am passing this along... there are comments from two other people who have also been asked if we keep guns in the house. The nurse just kinda slipped it in along with all the other regular questions. I told her I refused to answer because it was against the law to ask. Everyone, whether you have guns or not, should give a neutral answer so they have no idea who does and who doesn't. My doctor asked me if I had guns in my house and also if any were loaded. I, of course, answered yes to both questions. Then he asked why I kept a loaded gun close to my bed. I answered that my son, who is a certified gun instructor and also works for Homeland Security, advised me that an unloaded, locked up gun is no protection against criminal attack. The Government now requires these questions be asked of people on Medicare, and probably everyone else. Just passing this along for your information: I had to visit a doctor other than my regular doctor when my doctor was on vacation. One of the questions on the form I had to fill out was: Do you have any guns in your house?? My answer was None of your damn business!! So it is out there! It is either an insurance issue or government intervention. Either way, it is out there and the second the government gets into your medical records (as they want to under Obamacare) it will become a major issue and will ultimately result in lock and load!! From a Vietnam Vet and retired Police Officer: I had a doctors appointment at the local VA clinic yesterday and found out something very interesting that I would like to pass along. While going through triage before seeing the doctor, I was asked at the end of the exam, three questions: 1. Did I feel stressed? 2. Did I feel threatened? 3. Did I feel like doing harm to someone? The nurse then informed me that if I had answered yes to any of the questions I would have lost my concealed carry permit as it would have gone into my medical records and the VA would have reported it to Homeland Security. Looks like they are going after the vets first. Other gun people like retired law enforcement will probably be next. Then when they go after the civilians, what argument will they have? Be forewarned and be aware. The Obama administration has gone on record as considering veterans and gun owners potential terrorists. Whether you are a gun owner, veteran or not, YOU'VE BEEN WARNED ! If you know veterans and gun owners, please pass this on to them. Be very cautious about what you say and to whom. They are coming for us, so unless you're an ostrich, do not stick your head in the sand..........
