I enjoyed our brief meeting and the presentation to you and your homeowners regarding the MX situation.

I have very much enjoyed reading your blog. I am a blogger as well and have provided legal advice to dozens of bloggers.

I was advised of some of your postings and while I can say that some of your criticism of the HOA is misdirected, it is clear that your heart is in the right place. I told your HOA that they should welcome your criticism. We are increasingly in an era of a need for more transparency.

I am told that the restaurant health code violations were resolved quickly. If this is untrue please provide me some details so I can investigate further.

As of Jan 1, the HOA will control (and be responsible for) all aspects of bingo. Once the previous years records are in the HOA's control the HOA will be more than happy to allow you and any other homeowner's review of those records. Of course, we will gladly respond to any governmental inquiry and will publicly share the communications we have with such agencies to the homeowners.

The HOA has authorized me to engage you in discussion and fully respond to any inquiries you make. I hope this will bring about some renewed appreciation for openness in these matters.

Why do we need the developer to sign us up to cable TV for life? Can't we do this on our own or are we unable to do it because of our age or is it just too difficult. I guess he feels we need a helping hand or we just have too much time and money on our hands and he wants to lighten the load a little bit. It sure is nice to have a friend like him, never shows his face, never see us at the coffee meetings, the only time we see him is making a deposit at the Center St Bank, and with my luck I would have to be behind him and its a good 30 minutes wait and the line is out the door.

The Developer

Don't you ever wonder how much money the developer makes from all his communities and if he is such a great guy why doesn't he join us for coffee some Monday morning. It would be great to speak to the developer of this community, But here is the catch, he knows he has taken advantage of the residents here of Lake Ashton. You must know, if you follow crime, that the guilty has a tenacity of hiding and not speaking to anyone. He took advantage of all the ticket holders at Cypress Gardens when he closed its doors and now again he is taken advantage of the Lake Ashton Residents on MX.

Doesn't anybody here ever tell the truth!

I met the Ashton Grill Executive Chef Miguel Suazo this Nov 2 Monday morning and I ask him about the 30 Health violations he received this year. He said what health violations. I don't believe it. Then I saw Joe Hunter and would you believe he said the same thing. I guess they were all on vacation when this occur.

Is Mr White running away from the MX, leaving it for us to fight. I have not heard a final answer to this question. He told me he doesn't care how you vote, he alone will made the decision to hired a attorney. I thought he was elected to served the people of Lake Ashton. He really sounds like a politician, tells you one thing before the election and turns around after the election telling you just the opposite. It will be very interesting has to what he has to say at the up coming meeting. I believe he met with the developer and have a change of heart.

MX is a rip off

How can one be force to buy an entertainment cable against his own free will and to purchase it for life and beyond. When you are decease, your relatives will have to put up with it when your estate is on the market. They just can't shut it off and if they don't pay, the management will put a lean on your property. There are residents here who feel the same as I do and are not paying. Why should you pay for cable if you did not order it? This is the biggest rip off and scam and the most talked about subject here at Lake Ashton. How is he going to win this argument in court? No judge is going to rule on this. This is indeed a National news event. How can the developer have the guts to force us to buy MX against our own free will. There are people out there who doesn't watch cable, travel north for six months, so why should they have to purchase MX? Think again residents on MX, do you think this is fair?

Oklahoma did it anyway..

An update from Oklahoma :

Oklahoma law passed, 37 to 9, had a few liberals in the mix, an amendment to place the Ten Commandments on the front entrance to the state capitol. The feds in D.C., along with the ACLU, said it would be a mistake. Hey this is a conservative state, based on Christian values....! HB 1330

Guess what.......... Oklahoma did it anyway.
Oklahoma recently passed a law in the state to incarcerate all illegal immigrants, and ship them back to where they came from unless they want to get a green card and become an American citizen. They all scattered. HB 1804. Hope we didn't send any of them to your state. This was against the advice of the Federal Government, and the ACLU, they said it would be a mistake.

The federal Government has made bold steps to take away our guns. Oklahoma, a week ago, passed a law confirming people in this state have the right to bear arms and transport them in their vehicles. I'm sure that was a set back for the criminals (and Obamaites).... Liberals didn't like it -- But ...

Just this month, my state has voted and passed a law that ALL driver's license exams will be printed in English, and only English, and no other language. We have been called racist for doing this, but the fact is that ALL of our road signs are in English only. If you want to drive in Oklahoma, you must read and write English. Really simple.

By the way, Obama does not like any of this.

Bingo Paul admits breaking the law

ADMITS TO BREAKING THE LAW !

Even though he gives an impressive breakdown on how he has spent Bingo Monies illegally to help his 18 projects, which should be commended, HE misses the point !!

Florida Statute does NOT PERMIT offering Bingo Money to any entity
other than a CHARITABLE FOUNDATION / INSTITUTION.

This is the fact that he does not mention in his Article on Page 16. of this months LA Times.

The Truth does not wish to harm or deter Bingo at Lake Ashton.

I do not think however the residents here wish to be reported to the IRS for illegal actions. This could cause action that we would all have to pay for.

PAUL ... Remember....The money from bingo is earned in the Clubhouse owned by the members not you and You should not determine where the money is spent...

Why not call Bingo Paul in to a Local State Office .. Ex Bartow, and have him explain his recent article in the Dec LA Times ??

My reply to Jeff Salvin, president of the CDD

We at Lake Ashton give approx $5 million to the state treasury and we get nothing for it except trash pick up and we also have to pay $60,000 taxes on the clubhouse, pay for the street lights and maintain the roads and we also have to pay for security. They don't fixed the roads, put up stop signs, nothing, I say we at Lake are getting screwed. I say 95% of our tax money is going to other places, in other words to other parts of the city. We should get on the phone and call the city has to why our tax dollar is going elsewhere. We are getting rip off by the developer on MX and also by the city in taxes.

Our most famous resident Lloyd Van Sickle, Mayor of Lake Wales, does nothing to help the residents of Lake Ashton, absolute nothing but pockets all the residents money and gives it to the Lake Wales shack communities. If that is not enough he brings in the police and fines the residents for going thought the stop signs. He lowered the speed limit in front of Lake Ashton from 60 to 45 mph. He is sucking our money faster then we make it. I feel the residents should send him a needy Christmas gift, a gold police badge. Did you see him get up in front of the CDD committee and brag about the police being here. This guy has problems and he reminds me of Bingo Paul. He loves to call the police, I know, he call the police on me thinking I had an AK47. Can he do anything himself or does he rely totally on the police to do his job. I think I will call him absolute nothing, call the police Van Sickle.

Bingo Paul

Bingo Paul is now getting on edge that he is now being investigated by the state Attorney General of Florida for illegal wrong doings. There is a good chance the local newspapers will pick up on this story. Bingo money must only be given to charitable organizations not to Lake Ashton management for repairs, supplies, and improvements. Sorry, I don't make the law but Bingo Paul should have some knowledge of this. The CDD must charge a higher fee to rent the hall so that they and they alone can spend the extra money from Bingo. Bingo must follow the state gaming laws. If you think that one should believe that all the money that is generated through the concession stand and 50/50 paid for all the items he listed in the LA TIMES, I have a hard time believing this. Here is the list of items.
LAVA, Bocce Ball, cleaned chairs and drapes in ball room, new laptop, refinished ballroom floor and exterior doors, bird deterrent, kick plates at outdoor grill, Christmas decorations, 3 microphones, sound box, pledged $12.000 for new carpet, new 2 sets of balls and hand vacuum for billiard, supplies for duplicate bridge, and the list goes on. The only money he gave out of Bingo is Alzheimer's research and care packages overseas. This does not add up. Paul if this is true then E-Mail me the income sheets from 50/50 and the snack bar and I will post it on my Blog. I want the truth.

2915.10 Bingo records retention.

(A) No charitable organization that conducts bingo or a game of chance pursuant to division (D) of section 2915.02 of the Revised Code shall fail to maintain the following records for at least three years from the date on which the bingo or game of chance is conducted:

(1) An itemized list of the gross receipts of each bingo session, each game of instant bingo by serial number, each raffle, each punch board game, and each game of chance, and an itemized list of the gross profits of each game of instant bingo by serial number;

(2) An itemized list of all expenses, other than prizes, that are incurred in conducting bingo or instant bingo, the name of each person to whom the expenses are paid, and a receipt for all of the expenses;

(3) A list of all prizes awarded during each bingo session, each raffle, each punch board game, and each game of chance conducted by the charitable organization, the total prizes awarded from each game of instant bingo by serial number, and the name, address, and social security number of all persons who are winners of prizes of six hundred dollars or more in value;

(4) An itemized list of the recipients of the net profit of the bingo or game of chance, including the name and address of each recipient to whom the money is distributed, and if the organization uses the net profit of bingo, or the money or assets received from a game of chance, for any charitable or other purpose set forth in division (Z) of section 2915.01, division (D) of section 2915.02, or section 2915.101 of the Revised Code, a list of each purpose and an itemized list of each expenditure for each purpose;

(5) The number of persons who participate in any bingo session or game of chance that is conducted by the charitable organization;

(6) A list of receipts from the sale of food and beverages by the charitable organization or one of its auxiliary units or societies, if the receipts were excluded from gross receipts under division (X) of section 2915.01 of the Revised Code;

(7) An itemized list of all expenses incurred at each bingo session, each raffle, each punch board game, or each game of instant bingo conducted by the charitable organization in the sale of food and beverages by the charitable organization or by an auxiliary unit or society of the charitable organization, the name of each person to whom the expenses are paid, and a receipt for all of the expenses.

(B) A charitable organization shall keep the records that it is required to maintain pursuant to division (A) of this section at its principal place of business in this state or at its headquarters in this state and shall notify the attorney general of the location at which those records are kept.

(C) The gross profit from each bingo session or game described in division (S)(1) or (2) of section 2915.01 of the Revised Code shall be deposited into a checking account devoted exclusively to the bingo session or game. Payments for allowable expenses incurred in conducting the bingo session or game and payments to recipients of some or all of the net profit of the bingo session or game shall be made only by checks drawn on the bingo session or game account.

(D) Each charitable organization shall conduct and record an inventory of all of its bingo supplies as of the first day of November of each year.

(E) The attorney general may adopt rules in accordance with Chapter 119. of the Revised Code that establish standards of accounting, record keeping, and reporting to ensure that gross receipts from bingo or games of chance are properly accounted for.

(F) A distributor shall maintain, for a period of three years after the date of its sale or other provision, a record of each instance of its selling or otherwise providing to another person bingo supplies for use in this state. The record shall include all of the following for each instance:

(1) The name of the manufacturer from which the distributor purchased the bingo supplies and the date of the purchase;

(2) The name and address of the charitable organization or other distributor to which the bingo supplies were sold or otherwise provided;

(3) A description that clearly identifies the bingo supplies;

(4) Invoices that include the nonrepeating serial numbers of all paper bingo cards and sheets and all instant bingo deals sold or otherwise provided to each charitable organization.

(G) A manufacturer shall maintain, for a period of three years after the date of its sale or other provision, a record of each instance of its selling or otherwise providing bingo supplies for use in this state. The record shall include all of the following for each instance:

(1) The name and address of the distributor to whom the bingo supplies were sold or otherwise provided;

(2) A description that clearly identifies the bingo supplies, including serial numbers;

(3) Invoices that include the nonrepeating serial numbers of all paper bingo cards and sheets and all instant bingo deals sold or otherwise provided to each distributor.

(H) The attorney general or any law enforcement agency may do all of the following:

(1) Investigate any charitable organization or any officer, agent, trustee, member, or employee of the organization;

(2) Examine the accounts and records of the organization;

(3) Conduct inspections, audits, and observations of bingo or games of chance;

(4) Conduct inspections of the premises where bingo or games of chance are conducted;

(5) Take any other necessary and reasonable action to determine if a violation of any provision of sections 2915.01 to 2915.13 of the Revised Code has occurred and to determine whether section 2915.11 of the Revised Code has been complied with.

If any law enforcement agency has reasonable grounds to believe that a charitable organization or an officer, agent, trustee, member, or employee of the organization has violated any provision of this chapter, the law enforcement agency may proceed by action in the proper court to enforce this chapter, provided that the law enforcement agency shall give written notice to the attorney general when commencing an action as described in this division.

(I) No person shall destroy, alter, conceal, withhold, or deny access to any accounts or records of a charitable organization that have been requested for examination, or obstruct, impede, or interfere with any inspection, audit, or observation of bingo or a game of chance or premises where bingo or a game of chance is conducted, or refuse to comply with any reasonable request of, or obstruct, impede, or interfere with any other reasonable action undertaken by, the attorney general or a law enforcement agency pursuant to division (H) of this section.

(J) Whoever violates division (A) or (I) of this section is guilty of a misdemeanor of the first degree.

My reply to the LA Times on page 16, Dec Issue

First of all, you lied to Jessie Ayres, "the guy that looked into Bingo and got everything started" that a member of the HOA must be on the Bingo committee, and in that process, you slowing took over the game and Jessie was gone and out. He felt like he was screwed and no one cared, so he sold his home and got the hell out of Lake Ashton just last month. Jessie I want you to know I care, and I also know Paul accuse you of putting $20,000 in your pocket. I know that is not the truth. Another thing as I was playing with my cats in the rear of my home with my back against the Golf Course, I heard someone shouted "ASS HOLE". I had no idea who it was until I got up and ran down the golf cart sidewalk and it was Bingo Paul Pontious. On another day, I try to leave my Lakeashtontalk blog card on all the tables at Monday Morning coffee meeting and he saw me and came over and said you can't do that or I will tell Joe Hunter. He also told Joe Hunter that I was taking water from the little pond next to my house. Received a letter from Joe saying don't do that. Yes he is a loser and a lier. He will tell on anyone and he walks around like he knows all the answers except the Bingo State Laws. The only honest thing he did was he gave care packages to the boys overseas and donated money to Alzheimer's research and in both cases he did not tell you how much money he gave. All the other things he did was illegal. He just doesn't get the picture. This case is no longer in the hands of the truth "lakeashtontalk" but in the hands of the state. Don't worry Paul I'll send you a Christmas card. And did you notice that they just call my blog a blog and "Posted by the Truth", they did not say "lakeashtiontalk". What a bunch of losers. Most of the articles in the LA Times are written by Tricia Adams. Do you think she has the guts to post lakeashtontalk in the LA Times?

For all you Mainers out there

A man in Topeka, Kansas, decided to write a book about churches around
The country. He started by flying to San Francisco and started working

Going to a very large church, he began taking photos and making notes.

Seeking out the pastor he asked about the phone and the sign. The Pastor answered that this golden phone is, in fact, a direct line to Heaven, and if he pays the price he can talk directly to
GOD. The man thanked the pastor and continued on his way. As he continued to visit churches in Seattle, Phoenix, Salt Lake City, Reno, Denver, Oklahoma City, and around the United States, he found more phones, each with the same sign, and the same answer from each pastor.
Finally, he arrived in Maine. Upon entering a church in Fort Kent- Behold - he saw the usual golden telephone. But THIS time, the sign read "Calls: 35 cents".
Fascinated, he asked to talk to the pastor, "Reverend, I have been to churches in cities & towns all across the country. In each church I have found this golden telephone and have been told it is a direct line to Heaven and that I could talk to GOD, but in the other churches
The cost was $10,000 a minute.. Your sign reads only 35 cents a call. Why?"
The pastor, smiling benignly, replied, "Son, you're in Northern Maine now ... You're in God's Country, It's a local call."

Pet Carnival Top Cat or Dog was fixed

The pet carnival was not honest in every sense of the word. There was a $100.00 check in the voting box for Sassy, a Papillon dog own by Lee Armstrong. The second that check was drop in the voting box, her dog was a winner. This Top Dog contest was fixed. It is so sad that just about everything that is being done here at Lake Ashton is not on the up and up. Lawyers are being hired like their going out of style.
