To the idiot that said subsurface groundwater ruined our roads:

In 1995, before the roads were built, the developer's own geotechnical consultant recommended that because of the high water table, subsurface drains should be installed under all of the proposed roads. These drains were never installed. This document is in the hands of the CDD attorney.

Why do you try to mislead us?

Barbara Follett

How is it that an employee of the developer/management company, Barbara Follett, has the power to rearrange the leadership of our community's financial custodian -- the CDD Board of Directors? Keep in mind, that developer/management company holds contracts (worth over one million dollars of our money) that are dependent on the decisions of that Board.
Ms. Stevens announced, on the record in the Jan 8th CDD meeting, that Barbara Follett (and her husband Bill)were the people who caused her to make a motion to remove the CDD Chairman (Mr. Salvin)midterm. The motion was seconded by Eaton and passed due to the vote of Stevens, Eaton, and Owens(an officer in that developer/management company). Stevens then nominated Jake Eaton for Chairman and the same three put him in office. Then the same three put Ms. Stevens in office as the Vice-Chair.
How is that?
Well Ms. Stevens' husband appears to be a manager for that developer/management firm. They also appear to have the ballroom reserved every Thursday night (through the services of Barbara Follett)at no charge to the Stevens. This is for square dancing lessons where every resident participating has to pay $3.00 to attend. Square dancing also appears to have non-residents involved. Free ballroom...money in the his pocket....hmmmm I would think that the people that are taken these lesions should quit. Keith is using the ballroom free at our expense and he is putting money in his pocket.
Then there is Mr Owens. Did he forget AGAIN to announce before the vote and comments that he is actually in the chain of command for Barbara Follett's employer. Isn't that a violation of State of Florida Ethics mandate.

selfishness of some of my fellow Americans."

Please pass this on to every one including every vet and their
families whom you know. How in the world did a person with this mindset become our leader? I didn't vote for him!!!

Reserve, National Guard service member or veteran of a military service

The City of Lake Wales did require compaction tests in the pipe trenches, only...many feet below the road bed. The person that posted this comment about cosmetics is woefully uninformed and probably desirous of footing the developer's bill for millions of dollars worth of corrections to our roads. Taxes

Why are the taxes for the clubhouse $70,217.38 and the taxes for the HFC building are $21,846.26 There seems to be a problem here. As you know these are public buildings, not private and should be tax free. What a mess. Hired more Lawyers, and more Lawyers. There is a restaurant in the clubhouse we pay the taxes and the developer keeps the profit. What a deal. A fool in every crowd. How dumb can people be and the traders are still eating there. He can sue us but we can't sue him. Wake up people there are residents out there with Chinese Drywall and he refuses to acknowledge this.

Roads and fees

There is great confusion on whether or not city inspected roads are in the district because in
many communities that are private roads, the county doesn't require inspection of the
private roads because they are going to be maintained by the homeowners association.
So I am assuming that is somewhat similar in this case. However, there are a couple
different things that apply here. Those plans and specifications have to be approved by
the city municipalities and in accordance of that, before you can ever lay the last layer of
asphalt a compaction test has to be done because of trucks and everything else going
over the sewer and water lines that are going to then be owned by the municipality. So
a compaction test is done, approved and accepted by the city. Whether the asphalt
thickness is accepted by the city, I cannot tell you, but I can tell you that the
geotechnical study done in Lake Ashton CDD shows that all of the specifications were
met. They do a boring to test the roads. I can also tell you that the roads were built
correctly here. In Florida you have many different factors that can affect the roads. We
believe subsurface groundwater is a contributing factor that affected them. There were
a few bad hurricanes in 2004 or 2005 that accelerated the groundwater table. From a
structural standpoint the roads were built properly. From a cosmetic aspect it may be a
problem though and we are still looking into that.

Road Testing

ROAD TESTING
There is a branch of engineering called "forensics". This means simply the "science of reconstructing". A visual inspection of Lake Ashton roads will indicate to even the most untrained eye that there are literally hundreds of locations where the roadway has failed. Testing the "good" portions of the roadway may not indicate the cause of failure of the "bad" sections of road, so we use the science of forensics to test at the apparent points of failure in order to determine the exact cause at the points of failure. All of the testing now indicates negligence in the design, construction, and testing of the roadway sub-base at these points of failure. The District engineer could perform one hundred or more additional tests at other apparent points of failure and they most likely would yield the same results. Mr. Eaton asked this question at the last CDD board meeting and received a detailed reply from the engineer. There is now conclusive evidence showing that a good portion of our roads were never built correctly. The developer, former engineer, and road contractors should pay to correct these defects, not the residents.

Clubhouse and HFC Taxes

The CDD Board file a petition with the Value Adjustment Board seeking relief from ad valorem taxes on these public facilities.
They expect a ruling from the Value Adjustment Board on January 20th .
There is case law out there that
supports their position so a petition was filed seeking an evaluation of these facilities and indicating that these buildings should be exempt.

There is no creditability with Margot. She has lied many times, have not told the truth, and is a person you must watch out for. You can not turn your back or she will stab you. Front Gate Security is a joke

This is the biggest joke of all. Every Tom Dick and Harry can come in, these are public roads thanks to the developer. You can't stop anyone from coming in, impossible. Even if you ware a black mask with two holes in it, you can still come in. You are paying for security that isn't worth a damn. They don't have cell phones that they can connect to other security guards. They have nothing, and your paying for it. They make you believe you have security here. HO HO HO What a laugh. This my friends is a big waste of money.

50/50 illegal or legal????

If it is illegal for the 50/50, and Texas Hold Em is possibly a problem how can we have a casino night? And why does anyone who lives in an area with no children that probably pays the highest taxes in Polk County think that we need to further subsidize the public schools? $18,000 would go a long way to fixing some of the things that are wrong within Lake Ashton. That is IF a casino night is any more legal than 50/50. Just sayin'.

My reply to this is that they are given the money to the schools which I think stinks. I agree with you, it should go to the community of Lake Ashton. Then it becomes illegal.

YES, HE CAN SUE US BUT WE CAN'T SUE HIM.

Good to hear from you. We managed to sell our home and get out, evidently "while the getting was good". I sent e-mails and made phone calls to Jim & Louise Greenwood after they left but they didn't respond. I also believe that a "gag order" was part of his settlement and in fact he may have agreed to some dollar amount with the Ashton attorney, although he denied this. I contacted one law firm (they were confident that I had a case but wanted money "up front" with no guarantees), the State Attorney for Florida (now governor), the City of Lake Wales, the ACLU and two or three local politicians. In my case I acted as my own attorney and filed the appropriate responses as the respondent, not as a defendant. I have all of the documents associated with my case on file if you would like to have a copy. This case dragged on with the Ashton attorney wanting me to pay for their expenses WHICH I DID NOT DO. Finally, because nothing was happening I filed a request to abatement and vacate ALL charges; after some time the court required the claimant (Lake Ashton) to proceed or the case would be closed, Lake Ashton never proceeded and the case was dropped. I PAID NOTHING AND AGREED TO NOTHING, regardless of the rumors. I also went to the City of Lake Wales because of the numerous cracks that were in the concrete floors and block walls. There are code requirements for jointing (to relieve stresses and expansion properties) in concrete and block walls, neither was followed. With that said, you must read the 2002 Building Codes that had been adopted during the period that my home was being constructed. All of the customary codes were listed as being adopted by the State of Florida and The City of Lake Wales yet at the very end there was a statement, escape clause, if you will, that had been added to protect the home builders in that area. I also raised the same question concerning the shoddy construction of the clubhouse and other infrastructure and judging from some of the comments I've seen nothing has been done about either one.

Developer force resident before a judge
Jim Greenwood of Dunmore Drive wanted to sell his home. He decided to place a for sale sign in his garage. It worked, a buyer was driving by and saw the sign and also Joe Hunter. The buyer was interested in buying the home but Joe Hunter was very much interested in calling his boss up and also Jim Greenwood. The first thing he knew he had a lien on his property and could not sell it. He tried to reason with the developer but he would not listen, just like Joe Hunter. They all had to go to court and Jim Greenwood made a settlement with the developer. Yes, he had to pay him money.
This is Paradise some people say, and you are closely watch by Joe Hunter. He knows what you have in your garage because he drives by every day and looks. What a life this guy has. He never helps the residents and he also does not care for them, so what else is new?

Letter from a resident
Sir,
We are retired and after 3 years wish to relocate back to be near of children in Georgia. Our problem surfaced when we attempted to sell our home in Lake Ashton. It
appears that we signed away all of our "rights" when we moved in. I know, read the fine print. We put a "for sale by owner" sign INSIDE our garage. We have been threatened with forceful entry to remove same and served with a Summons because we put up a sign and went around "Lake Ashton Resales", which is owned by the developer. The (non-negotiable) 6% commission they charge will go along way in our relocation expenses. The covenants do prohibit signs of ANY kind, yet they only target "for sale by owner" signs while ignoring numerous other violations, including signs. The sign issue has been tested all the way to the Supreme Court and found to violate the First Amendment, yet the harassment continues. Can you assist us?

4/10/2006 ACLU of Florida 4500 Biscayne Blvd., Suite 340 Miami, Florida 33137 To Whom It May Concern; We have been residents of "Lake Ashton" since December 19, 2003. We were aware of the "Covenants, Conditions and Restrictions that were presented with and during the "closing" process. Section 5.21 (signs) prohibits ALL signs from being displayed or erected anywhere within the "community". Given the general abrasive environment that appears to exist in “ restricted communities ” we decided to sell our home. Now comes the problem; the enforcement of Section 5.21 has been “ selective and arbitrary ” , at best, until we put a “ for sale by owner ” sign up INSIDE our garage. Approximately (9) homeowners had similar signs, yet myself and one other was singled out and served with Summons. I don ’ t remember signing away my “ Constitutional Rights ” as a condition for living in “ Lake Ashton ” . The U.S. “ Supreme Court ” (1977 & 1995) rendered an opinion that “ banning residential signs violates the “ First Amendment ” . It also addressed the proliferation of signs, visual clutter and stated that “ one sign per house does not threaten visual clutter. We are confident that more temperate measures could in large part satisfy the regulatory needs without harm to the First Amendment rights of citizens. As currently framed, however, this ban abridges those rights ” . If I am required to remove all my signs from my garage just how far into the interior is considered “ in compliance ” ? Shouldn’t there be some limits on just how far a developer can go when promulgating any and all covenants, conditions and restrictions, which clearly diminish our basic rights? Individual liberties in the home have long been a part of our culture and our law(s). I will appreciate any advise or assistance that you may render. Sincerely,

Ed, I couldn't help but notice all the comments about the "road problems" in Lake Ashton. The road problems go hand in glove with the cracked floor slabs and block walls, it's all relative. I also noticed that someone made a comment based on assumptions about two previous owners. It was stateded that they were sued, payed fines, had leins placed on their homes and basically were forced to move. I said it once and I'll say it again. There were no leins, I paid no fines and moving was my choice. As to the law suit, Lake Ashton pushed and I pushed back. After so much back and forth I filed with the courts a "motion to abate", meaning the next move was up to Lake Ashton. After a period of time and no further action(s) by Lake Ashton, the case was closed. Documents available to verify if so desired. As for the other party that was persecuted for "selling by owner", I don't know the details. I saw the following that had been written on the walls of a bunker in Vietnam:
