It would take me more than an hour to reach these places.

Patty is home now and wanting to sleep 24/7, home care is coming in 3 days a week, PT,OT,ADL, and wound care. She is still on a feeding tube at nite, and does not care to eat, that is our problem. Fourteen meds are needed and I look to get her off these soon. But I have a better chance of getting her well here at home than having her in the hospital. A month at Moffitt Cancer Center then nearly a month at Winter Haven Hospital and the rehab unit is to much.

Sanford's Police Department is entirely to blame for the "Travon Martin" shooting death. Anytime a gun and resulting death is involved, the shooter should have been arrested, period. Any Homeowner Association Neighborhood Watch associate should never be allowed to carry a gun, much less use it. Charging Zimmermann with second degree murder doesn't make up for the blunders committed by the police, besides, it is extreme.But, "Manslaughter" ! All this drama and media news could have been avoided, had the police acted correctly.

THE DIFFERENCE BETWEEN HOA AND CONDO LAW – IT’S LIKE NIGHT AND DAY!

By Jan Bergemann Published November 2, 2012 To be very honest, I am at a total loss when I look at the HOA Act the Florida legislature created with FS 720. Sometimes I wonder why they created this statute at all, considering that the provisions contained in this statute have no teeth -- and it is widely known that even the best laws are useless without any proper enforcement tools. The history of FS 720 clearly shows that enforcement of its provisions is only possible for homeowners who have lots of spare change in their pockets. The biggest “joke” in the statutes is one sentence. Many good families lost their homes and life savings because the following sentence headlines the whole Florida HOA Act: FS 720.302(2) The Legislature recognizes that it is not in the best interest of homeowners' associations or the individual association members thereof to create or impose a bureau or other agency of state government to regulate the affairs of homeowners' associations. In all honesty, the only ones served by this sentence are specialized attorneys and their bank accounts – to the detriment of the homeowners living in these community associations. While the FLORIDA CONDO ACT (FS718) has many detailed provisions that can be partially and easily enforced by a regulatory agency (Division of Florida Condominiums, Timeshares, and Mobile Homes), approximately 2.5 million homeowners living and/or owning property in these homeowners’ associations are treated like unwanted stepchildren by the Florida legislature. With the existing, unenforceable statutes in place, it’s a financially risky proposition for retirees and investors to buy property within these communities. Homeowners are left to fight for themselves with no help to enforce the existing laws. Simple matters, such as elections, record requests or financial issues, turn into expensive lawsuits that can quickly become monsters eating up families’ life savings. Many homeowners run around with blinders, ignoring permanent violations of Florida statutes, because they don’t want to risk spending their last dime on legal bills. The proper legislation that would make life in homeowners’ associations much easier – and less expensive – is in place, but only for condominium associations. The provisions contained in FS 720 are stacked against the homeowners, especially since in many associations budget shortfalls caused by unpaid dues and/or foreclosures are causing heavy financials burdens on the owners still paying their dues. High legal bills are creating an even bigger hardship on the owners still paying the ever-increasing assessments, caused by the fact that the provisions contained in the HOA Act FS 720 provide no easy solutions for simple disputes. The question that baffles everyone: Why is the Florida legislature unwilling to enact simple laws that would stop most of these shenanigans we are all reading about daily in the media? The established wording from the condo statutes could easily be used for the HOA statutes. Case law and the Florida Administrative Code is in place. Nobody has to reinvent the wheel. But who fights these bills that would simplify life in HOAs in Florida? The only feasible explanation: The service providers, especially the attorneys that claim to lobby for the associations. They are the only ones who benefit from these useless HOA statutes. It is definitely easier to fleece the owners if the laws are confusing and can be interpreted any way anybody wants. With the statutes for HOAs it is very easy to create mini-dictatorships and fill their own pockets – if some determined folks so desire. To me it seems so simple. If you are going to have rules you should also have a simple effective way to resolve disputes that does not require lawyers and large fees. Home owners are being denied their rights by virtue of the fact that it costs a small fortune to fight even relatively simple disputes with HOA's. When are these Florida Legislatures going to wake up and do whats right for the homeowners in an HOA's in Florida. We need to all get together and get after these legislatures to sponsor a bill to get these necessary changes completed ASAP. Without these changes, all it does is over load the courts and make all these HOA attorneys fat rich. It's time to stop talking about it and get this done!

"We have seen a significant increase in HOA delinquencies," said Attorney Fred Elefant. David Kordek is one of the statistics. "My biggest fear is being without a home," said Kordek. Kordek is trying to hold on to his East Arlington Home. Recently he had his mortgage modified but now he's facing another hurdle -- a foreclosure for late HOA fees. "It is very stressful on my wife and I," said Kordek. "I contacted the homeowners association as soon as we were granted the home mortgage modification after fighting with that for three-and-a-half years." Kordek is behind on his HOA fees. The past due amount is approximately $1,400 including late penalties, and attorney fees. "People don't care about people anymore. Everything is just about money and that's it," he said. Kordek lost his job in 2009. Real estate attorney Elefant said that's when they saw a significant increase in property owners falling on HOA fees. Kordek said he had no choice. "We had three years of not nice holidays with no money. We're going to have a fourth, but on the bright side, I have a job," he said Kordek said his wife is battling liver cancer and that has added to his already stressful situation. "When you compute all our bills, all we have is $301.76 left over," said Kordek. Under Florida statute, an HOA can foreclose on his home to collect the past due fees. Kordek finds it hard to believe that he could lose the 17 years he has invested into his home for past due HOA fees that amount to about $1,400. The reality is he can, and now he feels the grip on his home slipping. "Its like a roller coaster ride," said Kordek, "You fight and fight and then you find way to clear a hurdle. Then you think you're going to move forward and then another hurdle and then you're looking at 'how do I deal with this?'" Your home is normally exempted from such claims, except for your bank and your HOA. Attorney Elefant said a property owner can seek bankruptcy protection or appeal to the HOA. Charlene Thompson is with Kordek's HOA and said they will discuss his case at the December meeting. Thompson said the decision to move forward with a foreclosure or to work out an agreement will be made by the HOA board of directors.

School Teachers

School Teachers are running this community, and they are doing a hell of a lousy job. CDD and the HOA. The husbands and wife's are on both boards. I can't blame anyone for not running. This place is not a private community but a public one. Anyone can come in and use the facilities. They have hired lawyers to get rid of the MX. Thousands of dollars gone to hell and we still have the MX and this has been going on for 4 years. Bingo is not a 501-C How in hell can they get away with all this crap. Bingo Paul is not in jail yet, I am still waiting. The clubhouse is being used by the outsiders. We were all told this is a private community. My good friends we were lied to. No one cares and I care no more. Nobody gives a shit and no one is doing anything.

Tricia Adams and her monthly column in LA Times

I have gotten many reply's from my readers about registering your guest and her column by a no brainier Tricia Adams. What does she think we have for a guest, a terrorist. Not only do you have to go shopping for food that morning for the guest, and when you get home you must call the security gate and let them know you have a guest coming. After all this, you have to drive down and register your guest at the activities office. What happens if its on the weekend? Nobody is there at the desk. Tricia what is your home phone number? She has no brains and should be fired. ASAP I call this place the Lake Ashton institution. Eric Nelson, a resident of this community, seems to think this is great idea to register your guest and ban the pick-up trucks in this community. He is telling everyone to mind their own business. I bet he has never register his guest or own a pick-up truck. I believe he stuffs his mouth with pop corn and watches the cartoons on TV and users the L A Times as toilet paper. He has never done anything for this community, he says. Zero! Yes, we do have many idiots living in this community. They are incapable of thinking.
