2010 Community Association Legislation You Lost your right

There are myriad opinions concerning Florida community association legislation passed this year.
We are very disappointed the Community Association Protection Act did not get support this year and the legislation that passed was so entwined by special interests that in some cases pollute the best interest of owners and members of associations.

CALL Alert for April 30, 2010 - CONTACT GOVERNOR CRIST AND URGE HIM TO VETO SB 1964!
The Legislature has passed a VERY BAD bill for Community Associations and Florida Consumers. It takes away the right to sue “design professionals” for their mistakes. Millions of Floridians who reside in Community Associations will have their rights taken away by SB 1964. On April 28, 2010, SB 1964 passed in the Florida House and will be sent to Governor Crist for consideration. Please write, call and e-mail Governor Crist today and demand that he veto this horrible piece of legislation.
What SB 1964 Does:
· It protects design professionals (e.g. architects and engineers) that fail to properly carry out their professional duties. For example, if a design professional designs a roof that collapses, the owners will have to pay to correct it and will not have the ability to fully recover those damages from the design professional that caused the problem.
· It gives design professionals immunity that no other profession has… not lawyers, doctors or accountants. Other professionals cannot limit their professional duty of care.
Why SB 1964 is Bad for Community Associations and Florida Consumers:
· Community Associations are constantly fixing their roofs, roads, balconies, seawalls, fire alarms, elevators, etc. with the assistance of design professionals. SB 1964 will limit the ability of Community Associations to recover damages when design professionals make mistakes.
· It will overrule numerous Florida Supreme Court cases and Appellate decisions which protect the rights of Florida Consumers to sue negligent professionals, including design professionals, for their mistakes.

WHY COMMUNITY ASSOCIATION BILL H561/S1196 WILL NOT HELP ASSOCIATIONS/OWNERS!

Houses Passes CS/CS/CS/SB 1196

Take a well deserved bow. You did it! Today the Florida House of Representatives overwhelming passed CS/CS/CS/SB 1196 (passed on 4/16/2010 by the Florida Senate) sending it to Governor Crist for his signature. Please take a moment to contact the Governor (http://www.flgov.com/contact_governor) and urge him to sign the bill right away. This is very important given his veto of similar last year.

Community Association Bill, 1196, Passes the House 107-4!

When the 2010 Legislative Session in Florida started back in March there were dozens of community association bills filed covering everything from lender reform to making it easier for buyers of bulk units to invest in failed or floundering condominium projects.
