elections in homeowners' associations are nothing more than a joke

Dear Florida Governor, Dear Florida Legislators, Dear Homeowners and Condo Owners:

Since many years we are telling the Florida legislature that elections in homeowners' associations are nothing more than a joke that allows sitting boards to create rules that make it difficult to hold a fair election. And board members are doing it with the help of specialized attorneys and managers, who are telling the board members how to circumvent the vague election laws in FS 720 in order to manipulate the outcome of the election.   
 
At the first annual meeting [http://www.ccfj.net/CCFJMarcusPointeAM.htm] the board of the Marcus Pointe HOA in Pensacola quickly adjourned the meeting without election, when the homeowners in attendance revolted against the fact that the board only wanted to allow the election for one open seat. Now, after realizing that actually four seats are up for election, they quickly created all kinds of rules, revoked voting rights -- violating the Florida statutes, invalidated existing proxies for the meeting and now require valid ID to vote. Funny, to sign the so-called JOINDER -- giving the developer annually $480 from each homeowner for the maintenance of a golf course that is not even part of the association -- no valid ID was required. And many homeowners still argue that the board didn't have the needed votes to pass this special assessment.

This is not just one single case of trying to manipulate the election, things like this happen in many homeowners' associations in Florida -- where FAIR ELECTIONS are nothing but a fairy tale.

Florida already has a bad reputation when it comes to FAIR ELECTIONS. The current board members of Marcus Pointe HOA shouldn't add another chapter to this sad reputation by trying to make voting difficult for eligible voters and proxy holders -- just in order to win the election with unfair methods.
